    Question reckless driving?

    Hi, I am in the state of NM. I had a question that reguards reckless driving, I understand that between states the laws are somewhat different. What is considered reckless driving? If an officer does not see you actually recklessly drive how can they come to the conclusion? How can they charge an individual on their own property of reckless driving? Thank You to whom answers. Also when you file for an appeal on somthing and one judge gives no jail time, can another judge say yes to jail time when you were already found no jail time?

    Those are Ask-A-DefenseAttorney questions, not Ask-A-Cop questions.

    When it comes to stuff like issuing traffic tickets, if an officer DID, it's an excellent indication that they CAN.

    Depends on the state, but yes in most states they can. Along with Curts response, no Officer is going to tie themselves up writing reports and tying themselves up in court if they weren't allowed to write the citation in the first place. Best start looking for another defense, like insanity.

    Also, remember that reckless driving includes engaging in behavior that is harmful to YOU, the driver, not just third persons and property.
