    Playwright needs Answers on What would a Police Officer do...

    This is the fictional situation.
    Man is in a Coma due to head injury. Police are called to investigate. Wife admits that they had a fight and she pushed him down the stairs after he purposely broke something of hers.

    I think it would be good for my play if
    1) she was arrested - (due mandatory arrests of spousal abuse?)
    2) put in jail
    3) bailed out

    QUESTION:
    What would the condIitons need to be in order for the above to happen - if it is at all possible - in an urban city?
    ALSO:
    How long would she be in jail.
    What would jail look like for her.
    Would there always be a restraining order on her (I need her to go back to hospital to visit her husband who will come out of coma.)
    Lots of questions I know, don't feel you need to answer all of them. Or you could direct me to a good resource.

    1) she was arrested - (due mandatory arrests of spousal abuse?)She would be arrested, the charge would be dependant on the severity of the injury, in this case in PA for example she would be charged with Aggravated Assault as well as any lesser charges that would be applicable. Criminal Attempt Homicide might also be charged if you could show her intent was to kill him by pushing him down the stairs. PA's Domestic Violence Probable Cause section wouldn't be necessary because it is a felony offense and she would be taken forthwith.
    2) put in jail In PA she would be charged and arraigned in front of a Magisterial District Judge who will set her bail based on the offense and whether he/she feels that she will abide by his/her orders and appear for scheduled court dates. It is possible (not likely) that a nominal or ROR (released on own recognizance) bond would be set and she might not be incarcerated at all. She might be committed to the local jail if she is unable to make the bond at the time of the arraignment.
    3) bailed out If she or someone else is willing to pay the required bond she gets out.

    Would there always be a restraining order on her (I need her to go back to hospital to visit her husband who will come out of coma.) The Judge will set conditions along with the bond, this typically includes no contact with the victim. With them being spouses it would depend. The interesting part will be him being in a coma when her preliminary hearing is held. Does he come out of his coma before trial or after? If not and she is convicted and sentenced and he then comes out and decides he forgives her and doesn't want her in prison, can her attorney file a Post-Conviction Relief motion to get her out? There are a lot of ifs. Lots of questions I know, don't feel you need to answer all of them. Or you could direct me to a good resource.

    I would have to say that if someone intentionally pushes someone down the stairs, and they're seriously injured, they're going to jail whether or not its domestic.
