    posession

    Hi i work for a company that does random drug testing. I dont use drugs or anything. Well i was just talking with one of the nurses and she said that some perscription drugs stay in a persons system for up to 30 days even if they are not causing affects. I also have a criminal justice teacher that said on several occasions that deputies in his jurisdiction have been able to get a blood sample from a person and charge them with posession since the drug is in their system. I was wondering if the same thing could be done with drugs around the 30 day mark or if that type of thing has to happen right away. If anyone could help me out that would be awesome. Once again i am not a drug user, i am just curious.

    if it is a prescription drug, and you have a valid prescription, then the question is moot! Some drugs will stay in your system for a while, but it doesn't matter if you're covered with the Rx

    I did think at first that the teacher was just messing with the class but he seemed pretty serious about it and he has been a deputy for a long time. Could it also depend on if the DA wants to charge a person using this as evidence and maybe his jurisdictions DA is a rebel?

    drugs in your body is not possession, BUT if you get pulled over for DWI and somehow end up doing a urine or blood test, and that comes back positive, that could hold in court.

    I'm aware of some places where minors can be told to blow into a PBT and then be charged with MIP if it registers over a .02 BAC. Other than that, I've never heard of charging anyone with a possession charge based off of a blood or breath test.
