    Question Question for school

    I know you guys don't typically help with homework, but I have been looking for the answer to this question for the past week and still can not find a state statute that would hold true here!!!! I will write the scenario and hopefully you guys will be able to start me in the right direction.


    Scenario:

    A local code enforcement inspector was completing his routine inspection of a computer store. Know that the business was very lucrative, he decided that he would use this opportunity to make some extra money for himself. The inspector told the owner of the business that several electrical outlets did not meet local code requirements. He advised the owner that he would fail the inspection unless he gave the inspector $1000. If the owner gave him the money, the inspector would falsify the report and make it appear that the store passed the inspection. The owner fo the business wanted to pass the inspection, so he gave the inspector the money.

    Based on this scenario, identify the crime that the inspector committed.

    In Wisconsin, it could be Misconduct in Public Office 946.12 -or- Bribery 946.10

    Read 946.18 to see if it applies to a code inspector. I suspect it does.

    Edit: Go with Bribery.

    Thanks Curt, I was limiting my searched to the selected excerps, maybe I should look beyond that next time huh......:rolleyes::rolleyes::rolleyes:!

    5301 Official Oppression Misd 2nd

    A person acting in an official capacity who takes advantage of another by subjecting them to...seizure, detention, mistreatment, lien, or infringement of property rights commits this offense.


    3923 Theft by Extortion Misd 1st

    A person commits this offense if he intentionally obtains or withholds the property of another threatening to take or withhold action as an official .

    Its for my criminal law class, she has us look up useless information for EVERY exam/assignment. Funny thing is she has had us look up the ones we will use almost daily such as DC.

    She was a past District Attorney and she teaches the class like we all want to be lawers not LEO's.

    In all seriousness, pay attention. Learn this inside and out. Memorize as much as you can. This is important stuff... something you'll use FAR more often than the toys on your belt.

    The better you get at this, the more respect you'll earn among the DA's you'll eventually have to work with.

    I am the only one in my class that takes notes, and is getting a A!!!!!!! I have got nothing but A's in all my CJ classes, mostly because it interests me (IN AND OUTS) and all!!!!!! Thanks for the help, I always pay attention in class, and I realize that you use these statutes more than your tools on your bat belt!

    Alright one more, but with what I wrote, just want differnet answers

    A crack addict wandered up and down the sidewalk outside several businesses. The police were called numerous times and responded to the scene. Each time they spoke to the addict, he was unable to provide them with a reason for his behavior. The businesses continued to call the police and reported that his presence was hurting their business because the addisct was scaring off many potential customers. The police responded back to the scene and arrested the addict.

    Based on this scenario, identify the crime that the addict committed.
    I said:
    I would not charge the addict. He is not doing anything illegal, wandering up and down the street is not a crime. Just because the individual is scaring off potential customers is not probable cause for an arrest. I would write him a ticket for loitering (if the city had an ordinance for it).

    This would be the same thing as a protest outside of the business (wouldn't it?).

    For protests you cannot block the entrance to a business or you will be arrested on disorderly conduct. Crack addict walking back and forth on a public street I'd go with a crime is about to be committed Burg,Rob, Crim Sale, or crime was being under the influence of a drug, loitering, drug posssession, discon, or harassment. Not enough info was provided so I'd call him an edp and have ems take a look at him. :D
