    Would I have gotten a Ticket?

    Ok I was driving form Denton, TX to Lewisville, TX on I-35E in heavy traffic. Through some combination of a moment of distraction and or following to close, I suddenly realize the car in front of me is braking very heavily. So I slam on my brakes only to realize that I going to hit the person in front of me, so I attempt to run into the grass medium while braking as hard as I could. The result is a 180 spin in the Aerostar I was driving.

    The van behind me driven by what must of been a girl of 16 + a few days, came to a stop about 2 inches from my bumper.

    The F350 behind her went rumbling past both of us in the grass at what was probably 20m.p.h follow by a Cadillac.


    My question is would or could I have gotten a ticket if anyone behind me made contact?

    This question has been asked many times before, but the circumstances are always a little different. Basically, the question is, "If a car is following too close and the car in front of it hits the brakes and they collide, who gets the ticket?"

    I am not a traffic investigator, but I always go with the car to the rear. It is a driver's responsibility to allow for room in front of their vehicle and to be aware of what is happening in front of them. It doesn't matter why the car in front brakes, the car behind needs to be able to stop in a timely manner. Enough distance is the only way to do that.

    So the answer to your question.....no.

    BUT...I was running radar on a four lane street last month. I saw two "rice-burners" coming down street, one following the other. Both were going faster than the posted speed limit and I were close to racing. The kid in front thought it would be funny to slam on his brakes to see what his buddy would do. His buddy ended up jerking the car into the two-way left turn lane. I issued the kid a ticket for unsafe braking.;)

    Thanks, I was slighty concerned becuase I wound up facing the wrong way on the highway.

    I just glad some angel was working overtime that day. 5 people following to close and no collision
