    Wink No I didn't get a ticket but....

    Have a traffic question....

    The other day I was driving down this road and of course hit construction. Well the speed limit sign read 25 MPH. Of course I do it. But about 300 more feet there is a permanent sign that reads 50 MPH. Mind you this 50 MPH sign is uncovered.

    Heres my little 5 minute diagram




    Now lets say after the 50 MPH sign, I get pulled over for doing 50. If the officer is wearing his hat, would the ticket stick?


    I know common sense says do 25, but we all realize people who drive somehow don't have it...

    Unless your state has a law that says construction zones are 25mph as rule of thumb, I wouldn't cite someone for doing the 50 until the construction co. got a right-of-way permit to cover the 50mph sign and did so. If the speed limit says 50, I'm not stroking someone who could have legitimately believed the speed limit was indeed 50. Not to mention the construction is far on the other side of the road.

    I dont know if a ticket would stick or not, but I think if you were cited for that, you'd have a hell of an argument in court.

    I forgot to add this earlier...

    The perm. sign that was for westbound traffic was covered up with a black bag like it should of been.


    I know it wouldn't make a difference but just add a bit more info

    The primae facae (spelling) was not met as the sign was not covered. I'm not going to go into the whole testimony and court specific language, but the chances of a cop writing it are unlikely, and of him winning in traffic court less likely.
