    Question BB Gun Laws in Texas

    Does anyone know the law in Dallas/Mesquite Texas regarding owning and possessing a bb gun? (In the house and car) EX: Does it have to be registered; if in car is it considered to be unlawful carrying of weapon?....my b/f got one and I want to make sure he isn't breaking any laws...we don't need any trouble Thanks

    UCW laws apply only to firearms. A BB gun does not meet the definition of a Firearm. So state firearms laws do not apply to bb guns.

    I am unaware of Dallas and Mesquites ordinances regarding BB guns. You should the City Attorneys office for each city you are curious about.

    Having said that - if the police pull him over and see teh BB gun (which I assume looks like a real gun) on the floor or in the console you can be sure his *** will be dragged out of the car felony-style...


    In the house, no trouble. In the car... I would certainly advise against that.

    I agree with not leaving it in the car. If someone sees it and thinks it's a real gun, they could call the Police on him and he might be arrested for aggravated assault since it appeared to be a real weapon. Some people will make up stuff like that whether it's true or not.

    There are quite a few cities around the metroplex that have made it illegal to have any replica firarm. If he drives through one of those cities with it, he would be arrested simply for possesion of it.

    My advice, keep it in the house.

    Mesquite Code of Ordinances
    Sec. 10-10. Discharge of air rifle, pellet guns, etc.

    It shall be unlawful and an offense for any person to discharge a projectile from an air rifle, pellet gun or other instrument in which the projectile is propelled by compressed air in, upon, across or into a public street, alley or other public thoroughfare or across a property line within the city.
