    Hit and Run on a animal

    Today my dog got hit on a main road by me.The speed limit is 35 on the road.She was outside my house on a chain,when we went to take her off the chain and bring her inside she bolted and just started running.My brother chased after her and almost caught her.Well when he went to grab her she took off again and bolted once again towards the main road,as a car was approaching my dog tryed to stop from being hit from the car andslid into the moving car at about 35MPh.The driver of the vehicle did not stop when he hit my dog.My question is could that person that hit my dog could they get in trouble for not stop after hitting her?My dog wasnt killed or anything she alot of scrapes,a couple fractures and some other things?

    I believe that would be considered leaving the scene of an accident. As far as your dog, she is considered "property" only.

    I can't think of an Offense the driver committed, other than being a bit heartless. The dog is property, but criminal mischief on a dog? Sure you knowingly hit the dog...

    Not to rub salt in the wound, but here the State Patrol would take care of the hit and run part and the county's code enforcement gals would issue you a citation for dog at large. It's not pretty, but it's the truth.

    Glad to hear that your pup will be OK though!

    in NY I think it's a violation for leaving scene of certain domesticated animals, BUT I'm not 100% sure.

    I think that charge could be laid on him for animal crualty and flight at an accident scene. I am pretty sure about it...... he hit the dog, he knew about it, he didn't stopped pesonnally i think that chances are good.

    but I think that in usa, you have a division in your departements about animal protection service and I think that if it's the case it will be theme who will handle the case...

    There is a Transportation Law in Maryland for failure to stop after striking a domestic animal. I don't know the title off hand.

    Of course, if their vehicle was damaged they could sue you civilly for the damage to their vehicle since your animal wasn't restrained and kept out of the roadway.

    NO hit and run here. You are obligated to keep your animal under control and although a dog is property , it doesn't count when the property runs into the path of the car who didn't stop.

    I would think that because the dog was loose there would be nothing you could do to the driver. I know she just got loose but she was still loose. Not saying this to be mean it's what I was told for one of my dogs a while back.

    Hope your dog is OK!!!
