Fake gun robbery

Ok, Got into a fight with a friend of mine so I have a question about committing a robbery with a fake weapon.

If a robber uses a fake gun in robbery will he be charged with robbery with a weapon or just a robbery? I know he will do time but will he do time for holding the gun during robbery as well?

In my city we would charge the person with Aggravated Robbery (robbery with a weapon). The victim has no way of knowing that the weapon is fake and is still in fear for their life, so therefore it's still an armed robbery.

The same here. We would charge them with Aggravated Robbery. It is what the complainant believes at the time of the offense. They may be in fear of serious bodily injury and/or death and not know the weapon is fake. That is after the fact info.

We had a " toy gun" robber here recently. Doesn't matter , if the victim is placed in fear thinking it is a real gun, it gets treated like a real gun.

BTW , if you got into a " fight " with a friend...what exactly happened that it made you cross over into the thought of using a fake gun in a crime ???? Did you pull a gun on someone or pretend that you had a gun ???

And like they said ^^^ There's no way to tell if the weapon is real or fake, so it's seen as real.

Oddly enough in NY, the firearm has to be loaded for it to be a class B felony, if it's unloaded/defective/fake/etc it's a C felony.

I never pulled a weapon on anyone and the fight with a friend was verbal and not really a fight it was about who's right and who's wrong. I play airsoft and recently read that 6%-10% of robbery's are committed with a fake weapon so the robbers aren't charged with a possession of a deadly weapon. I guess we both right....I guess it all depends on the state and their own laws.
