    Need Advice

    i just got a speeding ticket today, and this ticket can get my license suspended, i live in New York. you guys think i can take defensive driving first and take away 4 points on my license AND THEN plea guilty to the speeding ticket? would that work?

    Don't know as I don't reside in NY. Why not call the court by phone or go there in person and find out what your options may be? Or, call an attorney.

    Hype, hello and welcome to the board.
    I live in NY, but am a little confused on what you want to know "will work".
    Are you in jeopardy of having your license suspended because this is your third ticket in 18 months, or will this be a ticket that puts you over the 18 point mark? OR, is this a misdemeanor ticket that part of the punishment is to be suspended?
    If this is your first ticket, and it alone will put you over the 18 point mark, then taking a DD course will NOT help with that. The reason is that DD courses will not give you a 4 point "credit" on your license; they only apply the credit towards points already on your license.
    If this is your second ticket, then it may help to take a DD course. You'll need to do it very soon though, in order to give the red tape time to catch up.
    If this is your third ticket, taking DD will not help. The only thing to do is to talk to the DA and hope they will let you accept a plea for a lesser charge that isn't a moving violation.
    Another option is to attempt to plead guilty to a lesser charge (if that is possible). Typically, in my area, the judge will allow that. There will be less points on your license, but the monetary punishment is much higher.

    If all else fails, it is possible in certain cases to get a conditional license. This license allows you to drive to/from work, school, and gives you one 4 hour period a week (you pick the same time every week) in which to get errands done, go to appts, etc.

    thanks stump.

    this is my third ticket i got it yesterday
    and isnt it 11 points?

    this third ticket will get me 11 points on the license..before i plea guilty to this ticket would i be able to takje the DD class and prevent my license from getting suspended?

    Short answer, NO.
    DD courses do not reduce the NUMBER of tickets on your license, but just the points.
    HOWEVER, if I were you, I would still take the course - it gives you a 10% discount on your collision and liability insurance. This discount is good for three years.
    And you're right.. its 11 points.. I was thinking 18 months and typed 18 for points too.

    umm i dont know if you get what im trying to ask..so one more time

    i had 2 previous tickets that gave me 6 points and that was a while back..then i got a speeding ticket yesterday that i did not reply to yet..i wanted to know is that if i take the DD class BEFORE i reply to the speeding ticket, would that let me get away coz i would only have 8 points on my license?

    Hyped, I completely understood what you were asking. You aren't understanding my answer.
    NYS will suspend your license if you have 3 tickets OR 11 points on your license in 18 months.
    Taking a DD course will NOT change the actual number of tickets on your license. It will only remove points. Therefore, taking a DD after getting a 3rd ticket that you are convicted of will still automatically suspend your license.
    If yesterday was ticket #2 for you, but it added up to 13 points, taking a DD course will reduce the points to 9, therefore preventing you from getting a suspended license, because you are at 9 points and 2 tickets in that 18 month period.
    If yesterday was ticket #3 for you, and the points will total 13, then taking a DD course will reduce the number of points to 9, but your license will still be suspended because you have gotten 3 tickets within 18 months.
    Do you understand now?

    11 points sounds pretty generous. I thought it was 6 points in a year here in PA

    For all those people that are in awe because they live in other states, not all state's driving points scales are the same.

    California gives fewer points than NY per infraction, but they allow fewer points before suspending your license.

    It's just a different scale.
