    Right of Way

    Have a questioin, I was making a U-Turn on a three lane highway at a light, it was an intersection with the highway making up two parts of the intersection and a shopping center exit/entrance and an office building entrance/exit completing out the 4 way intersection, the light where I was making the U-Turn was solid green. While I was making the U-Turn I saw a guy in his car coming out of the shopping center while I was halfway through my U-Turn. He looked back to see if it was clear but did not look right he came out heading right for me so I hit the gas screeched the tires and barley got far enough away where he didnt hit me. Who has the right of way? I'm guessin I had the right of way and the fact that he didnt look right untill he had allready started to pull out on the highway would also make him responsible if he hit me. This is what I think, I may be wrong so thats why I am asking. I live in Delaware if that matters any, and I didnt get hit but just was curious who has the right away or who would be at fault.

    We have a road like that here, but in order to make the U-turn, you must wait for the green arrow. Did you have the arrow?

    Was this guy turning right or left? Did he have any light at all? Was it red or green?

    I didnt have the arrow only the slolid green. He was turning right, and I was turning left so we both were heading the same direction, I started going north and uturned to go south and he was coming out going east and ended up turning to go south the same direction as me. His light had to be red because there were people waiting at the light so eventually cut across the intersection to head north.

    Your clarification on the arrow part is still a little vague, to be honest with you.
    If you didn't wait for the green arrow, my feeling is that it was your fault, for lack of better word.
    If you are saying there was not any arrow at that intersection (and no sign saying NO U-TURN), and his light was red, I would say it would be his fault.

    There was a green arrow, I believe not positive I went because it was clear going south and there was a green light going north. I was in the turning lane. There was not a no uturn sign posted either.

    Interesting question. In Texas I believe the person making a U-turn is required to Yield.

    I'm going to see if I can find a statute.

    See if I understand.....You were say, heading north, turning around to go south. He was leaving a parking lot on the west side of the road, facing east and turning south?

    If you were doing a Michigan U....I believe the person turning right always has the right of way here...This is if I understand your scenario correctly.

    ****Update****

    O.k. to add to what I have posted previously...

    If this is a one lane road: One lane going North...One lane going South....The person in the turn around has to yield the right of way to the vehicle on the west side of the N/S road turning South (Turning Right)

    If this is a multiple lane road: Two + lanes going North....Two + lanes going South....The vehicle on the West side of the N/S road has the right of way to turn Right into the farthest Right lane on the N/S road...And the vehicle in the turn around has the right of way to turn Left on the N/S road respectfully into the lane farthest to the Left.

    ***This is only if you two were at the same intersection together...If you had turned Left and he was headed Right out of a driveway that was South of this Intersection...then in Michigan I believe you would have had the right of way...

    And this is just for Michigan...I would suggest doing a Motor Vehicle Code search for your state...or get a MVC for yourself...or just call the your State Police.

    Sorry DC Law this was in my jeep cherokee but good try, and I would appreciate it if you wouldnt reply to my posts from now on I am directing my questions to everyone but you. Even txin was professional about it, and I respect that but not you. Talia the road was a three lane road and I do belive that I ended up in the middle lane and he came right out into the middle lane too not into the far right lane. But thinks for the info I might look it up online somewhere. Do you really think you could find a code for something so specefic?

    DC Law when everything that you say is condesending or negative maybe you have some personal problems you need to keep to yourself. Its ashame I havent seen you say one semi-positive thing since I've been on this board. Go take out your problems on someone else not me.

The first one was not all the cars fault but had something to do with it. I never said the second one was the cars fault and how does what happened show that I cant control my vechile I was controlling it fine until I had to avoid someone hitting ME. If I had not accelarated as I did he would have hit me so I avoided a crash BECAUSE I had control of the vechile. Norm peckish TODAY? Try everyday of his life.

    Ok thanks I will look it up, by the way I was allready turning when he was coming of the exit, but since I was making a U-Turn I was going slow and he was moving pretty fast so I way halfway through the U-Turn before I even saw him so there was no way out but to accelerate.

    And Norm just beacuse I have 13 posts dosent mean I havent looked at the forum before. Plus I have gone back into some of DC Laws posts and it seems every teenager/younger person asks a question its always there fault, parents are to permissive or something to that effect. It seems he likes to assume every teenager is wrong and that no young driver is a good driver. Thats how I judge him. Me having 13 posts does not mean anything at all. Plus the only person I am juding is DC Law not other members.

    Oh I didnt know Jesus posted on this board. When he is right he is right, what does that mean. When is right how can he be wrong too? Just because you too agree on something dosent mean its right either. But go ahead change the subject from the fact I supposedly know everyone on the board.
