Thread: Gun seized

    Gun seized

    My brother in law was working as armed security officer he was found guilty of a Midsmeanor A his sentence was 500 hrs of community work the officer in charge of him let him keep his job as security and keep the gun.

    Someone called ICE agency and reported that he has illigal aliens living in his home, the ICE agents searched his home and found any illigal, but a local police officer saw his duty weapon and put him under arrest and seized the gun. Later a judge said everything was ok and dropped the charge and released him to ICE agents for the illigals report investigation. My question is how can him recover the gun? we live in the state of Texas

    Contact the dept that has the gun and ask them.

    A conviction of a Class A misdemeanor will result in his revocation of his Security Officer card. I don't know who "the officer in charge of him" was, but state law does not allow a person convicted of a Class A to keep his Security Registration.

    ICE will not go search a house because "someone called and reported illegals in his house".

    A police officer has no authority to search a house for gun except for warrant. A police officer cannot just seize a handgun found in somoenes house unless the person was under a legal restriction from owning a firearm, such as a convicted felon.

    So was he convicted or was he not convicted? if he was convicted of CPW, his gun is gone.
