    Internet Fraud

    I have a question about internet fraud. My friend was recently approached by a guy on mIRC (chat room). He said he has two xbox's that were stolen in his possession. He was willing to sell them to him at a low price. He paid him over the internet for one. Days passed and he recieved no xbox. My friend then contacted him and then he admitted that he didnt send it. I know my friend would be in trouble if he actually recieved the xbox. But he didnt get anything, and it turns out, the guy doesn't even have any xbox's. If my friend were to prosecute him, would my friend still be in trouble too?

    Straight from the Missouri Law page. I would suspect most, if not all, states are like this in one form or another....

    Receiving stolen property.
    570.080. 1. A person commits the crime of receiving stolen property if for the purpose of depriving the owner of a lawful interest therein, he or she receives, retains or disposes of property of another knowing that it has been stolen, or believing that it has been stolen.

    2. Evidence of the following is admissible in any criminal prosecution pursuant to this section to prove the requisite knowledge or belief of the alleged receiver:

    (1) That he or she was found in possession or control of other property stolen on separate occasions from two or more persons;

    (2) That he or she received other stolen property in another transaction within the year preceding the transaction charged;

    (3) That he or she acquired the stolen property for a consideration which he or she knew was far below its reasonable value;

    (4) That he or she obtained control over stolen property knowing the property to have been stolen or under such circumstances as would reasonably induce a person to believe the property was stolen.

    3. Receiving stolen property is a class A misdemeanor unless the property involved has a value of five hundred dollars or more, or the person receiving the property is a dealer in goods of the type in question, in which cases receiving stolen property is a class C felony.

    I would just call that a "stupid tax" and move one with life.

    So your "friend" (you) willing sent someone money to purchase stolen property, then get ripped off and want the police to do something? Good luck with that one.

    Sounds like the stories I have heard about a person reporting that they got ripped off while buying drugs.

    I know that recieving stolen property is illegal, but my friend never got the xbox. The seller never had anything.

    You may not be guilty of a crime, however you are guilty of not being too bright.

    Tough luck, you can't fill a police report because you were ripped off attempting to commit a crime.

    "Officer, I wanted to buy cocaine from this guy, so I gave him $50, then he never delivered the cocaine, can you arrest him and get my money back?"
