    Lawsuit filed

    Hey everyone, i have a lawsuit question.

    Soon after i got my license when i was 16, i got in a car accident for taking my eyes off the road unfortunately..very stupid. At that time of the accident the officer asked my speed, i admitted to going to 10 over and he gave me a ticket. The driver of the vehicle i hit, filed a lawsuit now and it says trial date for summons march 2007.. (She just wants money) She was prancing around at the scene etc..

    What does this mean for me and my future of law enforcement? Will the lawsuit etc kill me? im so worried about this its killing me! thanks

    Anyone can sue anyone for anything...A civil suit will not necessarily prevent you from pursuing a career in law enforcement.

    No i dont. At the scene she was a very kind person asking if everyone is okay etc. Then the devils comes out of her. I didnt think she would bring it to this level. Im not bothered by the lawsuit, ticket, etc, i can live and man up to what i did and it was a mistake. I am just so worried about my future in law enforcement

    Was the ticket for speeding or something else? Just because you're doing 10 mph over, does not mean it's the direct cause of the accident.

    As the others have stated, anyone can sue for anything. Also keep in mind, that many injuries can be hidden until several hours after the accident. She may have suffered an injury and didn't realize it till hours after the accident, even after walking around as you have stated.

    How bad was the damage? Where exactly did you hit her? How many people were involved? There are too many factors that you are leaving out.

    8 months ago. i was doing 10 over but the reason for me crashing was trying to find something in my car. the crash left very minor damage. her car only gained a few scratches and license plate bent etc. but nothing much. my hood was the only thing damaged

    Sounds like a typical 'rear ender.' Your insurance company will handle this.
    Get over it, and continue on with life(I'm confused about 'how you think this will effect your future in LE).

    I too - am curious what the ticket was for.

    I don't know any officers that would write you a speeding ticket for 10 over (or any speed for that matter) without some sort of verifiable evidence of an exact speed (RADAR, VASCAR, Pace, Laser)

    Most wont even write a speeding ticket based on "speed from skid" ...... in this type of accident. Not when there are too many other appropriate charges that can be used (in Virginia at least) like "Fail to maintain proper control" "Following too closely" possibly even "Reckless driving"

    Most depts won't hire you with pending lawsuits. It has to be settled prior.

    Also I don't know the legality of naming a minor in a lawsuit, so it may be against your parents/guardian and/or the insurance company.

    When the officer got to the scene, he said "What do we have here... how fast were you going" I said i was going 45 in a 35 zone, then he wrote the ticket

    Sounds like there is a lot more to this story than what is being said. Have you recieved a copy of the police report yet, if not go get one. Also at age 16 it is your parents that are being sued not you. The reason for that you can not be sued yet your not old enough to enter a legal and binding contract.
