    Question on law

    Where (as section of GA state code) can I find information concerning what is allowed in recording converstions. I am in situation where a friend of mine is the victim of verbal harassment. (Place of employment.) Human Resources has been consulated to no avail. In fact the message of suck it up had been sent. I want to know basically what are the legal remifications of down right recording what is being said even if the limitations are for civil litigation. Can my friend be prosecuted for breaking law? I hear that when recording a conversation a regular citizen is obligated under law to inform the other party that they are being recorded. (Which would defeat the whole purpose of recording by the way.) I thought that only one party would need to give permission for the recording of a conversation especially in an area where privacy can not be expected i.e. parking lot for example. (Or within ear shot of the 12 other employees who signed the orginal complaint form.) Can this interpreted as entrapment?

    In NC, as long as one party of the conversation, consents to the recording... you're fine.

    In other words, the other party privvy to the conversation has no expectation.

    One can only be so Open Minded before all that mind **** spills out, stains and ruins everything.

    A long way from GA, but I'm going to pipe up anyway.


    Here, VIC, Australia, as long as the person recording the conversation is a part of the conversation, they may record it and odn't need the other person's consent.

    Okay which state? How do I find out if this state is one of them? Where do I look?

    In MS it is the same, as long as one person knows it is recorded then it is fine. This has recently come in handy in getting a child molester convicted. It also allows us to use digital voice recorders while on patrol.

    Likewise in Tennessee as long as one party involved knows your being recorded its legal

    In MN you don't have to advise the second party of the recording. I record a ton of conversations, including telephone conversations, and I save the digital recordings on my computer. It saved my butt this last week. I had a 16 year old kid that was being a real prick to some neighbors. Nothing really criminal, he just needed to be shaken up a bit. I called him on the phone and in a firm but professional matter told him to quit being a prick. He came in with his Dad two days later to file a complaint. He stated that I swore at him and threatened him. I was in the office and my supervisor came back and asked me about it. I told him that I was sending him an email with audio file attached to it. I asked him to play it to the kid and his Dad when he went back to his office. Needless to say they dropped the complaint.

    Thanks guys. I had a hard time understanding Ga code concerning this. Yes it is legal in my case. As for the one Yankee state where you must inform the other party of the recording. That is in PA.

    Heck, I just picked up a nice, new Olympus VN-480PC, complete with lapel microphone. Even if I'm out of range from the in-car A/V (or not on patrol), it will be recorded for CYOA.
