    Question on the San Fran handgun ban. (HA! Im a poet!)

    Since the state of Califorina claims pre-emption on all gun laws, and CCWs are good state wide in Califorina, what is going to happen when some guy/gal with a CCW from say, Orange County, goes shopping in Frisco and the cops find him with a legal gun? Will this person be arrested? Will the arrest stick? Will the impending lawsuit bankrupt San Francisco? :confused:

    Well in New York State there are various CCW permits. Upstate (north of the city) is a lifetime permit, Long Island is a few years. Neither of those is valid within NYC though. But this may be state law. Only a very select few, and ex Law Enforcement can carry in NYC. There's also premise permits, and all sorts of other stuff, but we won't get into that.

    So in summary someone from Long Island or Upstate could have a legitimate CCW permit for the state of NY, but not be allowed to carry in NYC. How does this compare to San Fran? I have absolutely NO idea.

    Yeah I get that, but according to www.packing.org, the state of california claims pre-emption on all laws firearms related. So a city cannot pass a ban on guns that the state deems legal. ( I guess, I am not a lawyer.) So a CCW issued in LA (hell it could happen!) is good statewide.

    I'm still wondering if you get compenstated for turning in your handguns? Like anyone will anyways, but i'm still curious. :confused: And does this go for LEO as well. What about HR218?

    HR218 is federal. City law cannot overrule state or federal law.

    San Fran might not be able to stop people with permits from other areas of the state, but they could "stop" issuing permits for the city of San Fran.

    i wouldn't do anything. i'm not sure how it is with nazifornia, but cities in Texas can only institute fine only offenses. city ordinances are considered civil infractions.

    the way i look at it is nevada will have beachfront property after the next big quake and we'll be back to 49 states; problem solved.

    I'd be turning in my badge, if I were ever able to move to such a **** town and get a job there in the first place. I would never turn over my firearms, and I would never expect a law-abiding citizen to turn over theirs.

    I am sworn to uphold not only the laws of my jurisdiction, but the Constitution as well.

    I am interested to see how the law enforcement of San Francisco handles this mess.

    I don't know about the compensation issue.

    I did read somewhere that Police and "Armed Security" that needed handguns as a part of their employment were exempt.

    The way I read HR-218, I see that LEO's still have to abide by the use of force laws and other requirements of the state. For example, "HR 218 will not be a defense to possessing hollow point bullets, carrying a weapon on a school campus, carrying a prohibited weapons, carrying a weapon in a casino, etc. Some of these scenarios are illegal in certain states. Know HR 218, but also know the laws of that state in which you intend to carry!" that is from the below link about HR-218.

    All I can say is they would have to come get my weapons....and THAT aint happenin'! Maybe the next BIG ONE wil dump that **** hole into the ocean...we can only hope.
