Question about a fight with a girl

Me and my guy friends were talking about this. Heres a scenario,

A guy is sitting at the bar with his friend and there are two drinks on the bar. A underage girl sits beside the gentleman and asks whose drinks are those for. The guy replies its for a buddy of his. She then asks could she have one. His friend leans into his ear and says, "You shouldn't give her that drink because you might get in trouble." The girls jumps in the other guys face and says "what did you tell him, you better not tell him anything stupid or I'll punch you in the face." This is a real story that happened to me. I was the guy being threatened with a punch in the face. Now lets say the girl went forward with it and punched me and gave me a black eye, then I retaliated with a punch back. She begins hitting me again and again. People come to break up the quarrel. Cops show up and there are witnesses around that saw the whole scene play out.

Would I go to jail for defending myself, and will the girl get off just because she is of a different gender?

There's a big difference between retaliation and self defense, maybe you should look up those definitions. If you did punch her I hope that someone had the decency to knock the **** out of you.

The law makes no reference to gender in self-defense. Your use of self defense must be reasonable, immediately necessary to protect yourself. Retaliation is not a defense, and you risk being charged with fighting in public or public intoxication.

Understand though, in my state use of force is a defense to prosecution, which means you CAN be charged with assault, and in court you have to prove beyond a reasonable doubt that your use of force met the legal requirements of self-defense.

Always better to walk away.

Not sure where you are at but if you were in Missouri, I would arrest both of you and charge you with either mutual affray or disorderly conduct and be done with it......

There is not a Yes or No answer here since you state there were witnesses who saw the while scene play out. Their evidence will play a major factor in the outcome.
What you see as defence may well appear different to a bystander.
The gender of the other person should make no difference, I'd rather break up blokes fighting than girls fighting anyday. :eek:

WTF?!?! What kind of sissy are you? Jesus! YOU DO NOT HIT A FEMALE, ever (unless she's about to kill or seriously injure you or someone else). If you have to take a punch from a girl, sucks for you, but don't hit a female.

Wow, I have never seen a black eye develop in the matter of seconds, usually takes a couple of hours

Tell the officer you retaliated against a girl by hitting her, that will go over real smooth...Even better, tell the guys in your holding cell :eek:

It was a hypothectical. I thought it was obvious the way I stated it. It never happened. If the girl is equal to the mans size and punches you without a reason giving you a black eye and you punch her back once in self defense then she keeps hitting you. The quarrel by the time is broken up. Would I get thrown in jail if that happened? Or would she just be thrown in jail? We have witnesses that saw everything.

I see some of the cops on this forum will arrest based on gender and not by the law. Like I said it doesn't cross the line of assault just defense. Cops shouldn't base there rationing just because they feel that its wrong for a guy hitting a girl back in self defense.

Are you serious , how is it impossible for someone to get a black guy from one punch. I got a black eye when I was a kid in a fight. I've seen someone get a black eye from a punch.

Hitting "back" is not self-defense, it is retaliation. In that case you go to jail.
