    civil summons

    I just found out my step son missed jury duty in California. I believe that it was the second notice too. He goes to junior college and stays at an apartment there so he is hardly home. Being that I married my wife when my step son was 18 years old, we are not on good terms. My wife and I are worried that he would be arrested for this act but I think it is a civil matter. However, being arrested would put a marking on your criminal record. This is how I thought it was to be. I have no idea what a criminal backround check looks like such as does it have "arrested missed jury duty" or does it only mention how many times you were arrested. I am worried about this because my wife and I are thinking that it is going to hurt his chances into transfering to a university. I believe the universities ask about this. It might even come back to "stab" him later on.

    By the way, I'm in a nurse but I hear about physicians getting pulled over on the way to the hospital but they are immediately released after showing credentials. Is this police policy now? Thanks again.

    He's a big boy, let him worry about it.... Being a step father in more or less your situation, I'd highly recommend staying as far out of it as you possibly can. If his mother wants to wring her hands over what he does or doesn't do, let her, but don't give advice nor get involved.

    Most criminal history checks generally available to the public don't include all arrests, just actual convictions for crimes. Where I live, the court could issue a civil body attachment (a kind of arrest warrant) ordering that he be brought before the court to explain why he didn't appear as ordered

    Doctors always get tickets.

    Nurses always get warnings.

    Why? Because one day, I'm gonna get hurt and wake up on an ER gurney looking up at a nurse. It would really suck to recognize her as one I cited for something stupid. I've seen what discomfort nurses can inflict when they want to.

    As for the civil arrest warrant, does the person get arrested and finger printed or is it just a citation delivered from the Sheriffs?

    Retdetsgt, I understand where you're coming from but she wants me to participate into the whole family. Regardless of the circumstances, they are still my family. Even though, we're not on good terms, we do go on family trips and etc...I even pay for his apartment and tuition. After he graduates and does his own thing, my wife and I would consider him a big boy.

    Here, the judge would order us to go pick the person up and bring them before the court. If their excuse wasn't good enough then they'd be in jail (photographed/fingerprinted...the works) for as long as the judge decided to hold them (usually 24 hours). They would in all likelihood be fined as well.
    Contempt of court is the charge that would show up on the criminal history.

    Maybe you all should cut the cord and start expecting junior to act like the grown up man he is now. Quit coddling him and worrying about his future (if he doesn't care about it there's nothing you can do anyway.) He needs to learn there are consequences for his behavior now and having mommy and daddy jump in with lawyers to rescue him won't achieve that.

    School is usually a valid excuse for missing jury duty. Whatever the circumstances are in your state, the best thing to do is have him contact the courts and explain the circumstances. They may want him to report or they may just take an excuse over the phone. Either way, he needs to quit avoiding the issue.
