    being pulled over...

    hey guys
    im new here..this is my first post
    i just had a couple questions and im wondering if anyone could help me out a little bit
    when you get pulled over, and an officer asks you to step out of the car, what are your rights in that "scenario"?
    also, does the officer need permission to search your car when he/she pulls you over, or if he has a reason to, can it do it regardless
    and finally, if you have a PBA card for a county or town, but you get pulled over in another county/town, can you try to use that?

    When you get pulled over, you have the right to do what you are directed to by the officer. Save your complaints and "tv lawyering" for another time and place. If he feels the need to do a search, just comply. That is the smartest/safest way to act. If there is something wrong with the search, judges and lawyers get LOTS of money to sort that out.
    As for PBA cards...save them for when you run out of Charmin, that's all they are good for! Hope this answers your questions.

    So I take it that you were pulled over, asked to step out of the car, your car was searched and in the end your PBA card didn't help much. Sounds like your questions have already been answered.

    Yes, I can make you and any passengers exit your car.

    The search issue depends on the state and the circumstances. A court determined unlawful search will result in any found contraband being thrown out.

    Your PBA card can be used to light your next cigar. I love it when people tell me they are a friend of one of the officers I work with. I'll ask them if they know the officer's home phone , where he/she lives, what they drive etc. 99% of the time they end up saying " I don't know them that well" .

    PBA card!!! Its a no go for you son! Keep that in your wallet. As the wise ol trooper said, just do as your told and how your told.
    Research your questions on the board also, they have been asked and discussed in leangth.

    so no, my questions i asked werent already asnwers, otherwise i wouldnt have asked them now would i

    I know this is the internet and I highly suspect you are in your late teens but in a public forum , the use of proper grammar ( such as using I instead of "i") impresses those of us to whom you seek advice from. ( and maybe employment from )

    I seek no employment, nor do I have the desire to impress anyone. I am merely asking questions, and I had hoped that being polite would bring the answers to my questions in a non-sarcastic or derogatory tone.
    Perhaps you could inform me if "Fraternal Order of Police" cards, "Police Chiefs Association" cards, or "Office of the Sheriff" cards (all signed by a chief/sherrif) are useful in any situation.

    By the point I ask you to step out of the car, you ARE going to come out of the car, one way or another.
    Most people step out nicely, others argue but still come out, and some are pulled through the window with taser darts stuck in them. But in any event, they ARE going to exit the vehicle.
    "Sir, can you please step out of the vehicle" is actually a secret police code for "get out of the car". It isn't really a question, it is just phrased like one.

    If I ask you for consent to search your car, you can refuse. If I just decide that I am going to search you car, not much you can do to stop me at the scene. Personally, I don't search people's cars unless I know I can defend my actions in search. What is the point of me searching if any evidence that I find is going to be thrown out. If I find dope/guns in your car, the first thing a defense lawyer is going to do is file a motion to suppress the evidence- whether the search was legal or not. No reason to waste my time just to have my case tossed.

    as far as the card.....If I'm considering giving you a cite, but havent made up my mind...and you pull out that card...you are definitely getting a cite.

    In a word, "No." What you are implying is that they are like the "Get Out of Jail Free" cards in the monopoly game or get out of a ticket. The true meaning of these cards at least in my opinion is identification to be used at functions where these organizations are the sponsors of an event. Using the FOP as an example a member of the public who is not a member of the FOP would not be allowed into an FOP event unless of course the FOP advertised the event open to the public.
    The cards are also an acknowledgement to you of a donation to the respective organization either through your membership dues or other special promotions such as special olympics etc.
    Also, still using the FOP as an example a member has to display an FOP membership card to gain admittance to the "lodge" if they are members from another state. So the "cards" are for use in the activities of the organization that issued them and nothing else.
