    Are there any Philly cops here?

    This post on another forum has me shaking my head in disbelief. Apart from the piss poor grammer, does this really happen in Philly?

    i was involved in a mva on 3-29-05.i tried to get out of the way of hitting a dog and nailed a bridge support at 50 mph.i broke my jaw,ankle,wrist,and 2 ribs so when the police arrived they took my gun off me before i entered the ambulance.i have a carry permit and gun is registered.

    my wife was given a property ricept for my g17,1 17 rnd mag,and 18 bullets.i did what city hall told me and wrote a letter to the police com office with a copy of my permit,and property reciept.now today i recieved a letter saying.

    the philadelphia police department is in reciept of your letter.the police commissioner has forwarded your request for the return of a firearm to the detective bureau for processing.upon completion of or investigation,you will be notified of the results in writing.

    is this bs or what they know the gun is clean,and that i was in a mva that did not involve anybody but that dig i hit anyway.i have other weapons,i am carrying my g23 right now,but i want my g17 back i only put 50 rounds through that gun it was 2 months old when i was in mva.

    That sounds like the same thread that had accused the Houston Police of doing the same thing. The guy that posted the Houston story hasn't showed back up......so who knows..... :rolleyes:
    He said that he was in a traffic accident and Houston PD took his Glock for safekeeping and now won't return it until they do a ballistics check on it.
    Not sure if someone is trying to get people riled up over there or not. But I know a few did with the Houston story....

    I wonder if they are waiting for an ATF trace? I only do those when I obtain guns involved in a crime or I think they were. The guns I've taken for safe keeping were immediately available for release from the property room, all they had to do was come and get it and bring ID.

    If we take a gun under those circumstances , we will arrange to return it to the owner ASAP. No written request needed, just call ahead to the station, stop by with photo ID , sign on the line and here is your gun.

    Yeah, it seems to me that taking a gun like that would be a clear violation of the 4th ammendment. But what do I know?

    I think that taking it was reasonable as he was going into an ambulance but keeping it without any kind of crime is definitely a problem. I locked up a guy for a felony DUI who had his CCW and a weapon in the car. He got the gun back right away despite the felony charges because there was no legitimate reason to keep the weapon from him. It wasn't being held as evidence so it was like any other property (like a wallet) and had to be returned. Even though I thought the guy was a sh--bag I had no legal reason to keep the weapon. The only reason I took it to begin with was so it wouldn't get stolen out of his car.

    We have a policy that every handgun we seize has to go to the County Crime Lab for a shot comparison...... under those same circumstances we would have done the same. As far as I know, no one has ever made issue of it.

    Yes Sir, but the pistol in the post I quoted was not siezed. It was taken of a CCW holder who had an accident and had to be transported to the hospital. By seizing that posters weapon, the Officer and the Dept. have violated that personsth ammendment rights. If that post is true, and I dont know if it is, and that happend to me, I would have sicced my assault lawyer on them. :D

    A SEIZURE is by definition the deprivation of liberty, or the enjoyment in exercising dominion or control over a thing, be it property or person.

    The gun was seized since it was taken into police custody because the guy was going by ambulance.

    Darn, no edit. I would have done the same thing as the officer. As a medic, I would never transport someone with a weapon on them, I would expect the police to take it for safekeeping.

    All that aside, the story stinks like troll.

    If the person was DUI even with a CCW, in Tennessee they would be charged with possession of a weapon while under the influence and the weapon would be seized. I know the guy is stating that he avoided a dog, but I have heard that excuse for DUI offenders as well. My .02

    I agre with that, but would you send it off to have ballistic tests run on it? Thats kinda jumping the gun aint it. :D (HA I made a funny!)
