In mos states, you'll get a fine the first time and your licese will also also be suspeded for driving on an expired license unless you take care of the problem.
Here, you would get arrested. The charge for an expired license is the same charge you would get if you never had a license to begin with. It's "Operating Without a License" and is a misdemeanor. You get arrested and the car gets towed.
Here you would get a summons. It's a fine and sometimes if you come to court with a valid OL the judge may rule complied with law and charge you just court cost. This is in VA.

It's a chippy charge here. Go down and get it renewed prior to court and the judge will probably dismiss it.

You will be placed into custody here and taken to the station. You will have to sign an I bond (which is a bond that requires you to show up on your court date). Failure to show will result in the issuance of a warrant. At your court date you will have to show that you have renewed your license. It will not be a valid defense but if you went and renewed it, most of the time the judge or states attorney will drop the charge if there isn't any previous traffic convictions.
For letting your license lapse? That's pretty severe. As I said, if it was valid when it only expired, it's not that big a deal here. Certainly not worthy of taking someone into custody.....Originally Posted by scootsmo

It's an arrestable offense in KY but as rds has pointed out..it's such a minor offense no one I know has ever actually arrested for it. However, it's nice that it is arrestable if you are trying to get into the vehicle to look for something else!

You will not be booked, fingerprinted or photographed. You take them in, write them the tickets, and order the tow if they have no insurance. The I-bond is bascally a promise to appear with the failure to appear being the grounds for the bond forfeiture warrant. The whole process takes about 15 minutes but has to be done in the station unless you have an I-bond book with you (seatbelt roadblocks, etc.) but that is rare. Severe? I don't think it is. It is a valuable tool to have the probable cause to do basically what you want such as custodial search, vehicle search incident to arrest or an inventory search of the vehicle prior to the tow which allows you to search the entire vehicle.
Wow, I guess we are pretty strict here in Maine then. As I stated earlier, they consider it Operating Without a License. Basically, someone with an expired license would face the same charges that a 15 year old who never had a license in his life would face.
I didn't let my license expire or anything but my A-hole friend did and just moved too so he can't get it updated here in NJ until he has all the info that proves he is he at his new address. I'm assuming that an expired license is more of a penalty for ID sake. You know how many people in NJ should go for another driving test everytime they get an updated license. Drivers in NJ are awful, atleast once your over 65 they should test you every year or something but it costs $$$ to do that unfortunately.
