Proper Public "U"... Any such thing?

What are the laws regarding public urination? Is it still illegal if my boyfriend takes some precautions to sheild himself from public view? If he walks into the brush, is this still considered "public?" Are there any exceptions, such as a true "do it or loose it" emergency? What about if he pulls aside, does it in a bottle while in the vehicle, then pours it out?

This new question regards my boyfriend, who tends to whip it out by the side of the road as deemed necessary with the attitude, "If they wanna watch, let 'em watch," meaning the cars whizzing by. He really has a tendancy toward modesty, but as we travel a lot and both love coffee, this has been an ongoing tension between us.

Thanks to everyone who answered my question regarding LEO use of public facilities. I not only got the answer to my question, I learned the why, also. Makes a lot of sense now.

Wow! When you put it that way, the natural and necessary elimination of body waste does come off sounding rather filthy and lewd. What was God thinking?!It's no wonder there are laws against it- in public anyway. I guess this is why bathroom mirrors are kept at standing, and not sitting height.

I'm kidding of course- and it was a stupid question. As with all laws, this one obviously also varies. And I asked it for the wrong reason. I just kinda wanted something to rub my boyfriends nose in. But as he's already been chastised by a highway patrolman (an event in which I was not involved, but of course was more embarrassed than he was), I doubt that showing him replies, even from professionals, is going to change his behavior. Guess I just gotta love the guy as is!

Taking a leak in the 7-11 lot will get someone a cite for Disorderly Conduct.

Taking a leak behind a tree along a highway out of view of the passing traffic isn't likely to bother me at all.

800.03 Exposure of sexual organs.

It is unlawful to expose or exhibit one's sexual organs in public or on the private premises of another, or so near thereto as to be seen from such private premises, in a vulgar or indecent manner, or to be naked in public except in any place provided or set apart for that purpose. Thanks for the info. It seems to me by the 800.03 code, pulling it out for legitimate purposes such as urination wouldn't fit under the wording, as doing so is not for indecent or vulgar purposes. Also, as he keeps his back to traffic, one would have to go out of their way to see anything, freeing him of any voyeristic intent. (With his back to anyone, there's only an assumption that he has it out anyway, isn't there?)

If you can't be seen, it would be impossible to catch you. The old saying that it's only illegal if you get caught applies here.

yep, considering there's not much open with a restroom when you work midnights. i had a couple of select areas i frequented. :cool:
