I don't know about Seattle but here we can write Summons on misd wieght weed and Paraphenila. It's not an arrest, you still go to court. I still take your weed and pipe.

If I worked for a Dept. that was gonna give me grief for arresting dime bag possesion charges. I'd write the hell out summons' for it, and still take your dope.

Good thing my Dept. wants us too arrest for any wieght.

I think they have a written policy that says they can't give you a summons or arrest you if it's a misdemeanor, they have to file a report with the city attorney. And the city attorney has an "unwritten" policy of always declining to file cases where the amount is below some fairly high level, like 1/2 oz or something. 40grams is the cutoff for misdemeanors in this state.

So I can imagine them being faced with the choice of filling out 5 forms and doing an hour of busywork just to confiscate an amount worth 30 or 40 dollars, fully knowing the charges will get dropped, or just giving it back. :rolleyes: Or ignoring the smell in the first place.
