    Question Arrest Procedure- PA

    In Pennsylvania can you be arrested without being finger printed or having your mug shot taken at the time of being arrested? Is it possible to get arrested and not get printed or photographed only to have to go back to the station several weeks later to get it done?

    Post processing

    In PA after your preliminary hearing the District Justice will order a fingerprint order for the Defendant giving the defendant so many days to report to the arresting department for processing,(fingerprints and picture). Some of the bigger Departments do all there processing at the time of the actual arrest. I hope this helps.

    I know what they are allowed to do in NY - issue you a ticket telling you to go get fingerprinted on suchandsuch a date. Usually they'll do it if you are arrested on a minor charge, and have cooperated fully.

    Is this about the DUI arrest of your sister ?

    I remember you posted a few questions about it before.
    Is it she hasn't been processed yet and you are wondering if she will ?

    When I was arrested, I was finger printed. However they never took any pics. And they never informed me that they would, I am unsure if this maybe the case with your sister or not.
    Perhaps she will not be asked to do anything until she is formally charged with DUI.
    Or even until she is actually convicted of it. You could call the station that handled this arrest, they would know more.

    Even though I was convicted of a crime, a mug shot still was never taken, or asked for. Again I am unsure if this is because it is to be explunged at the end of my probation or what.

    Be very careful. Expunctions are not automatic. If you received deferred adjudication that means you will have a finding of "not guilty" entered after you completed your probation, but all of the other records; arrest record, court case docket, etc., remain.

    An Expunction orders the destruction of everything related to the arrest, including police reports, files, etc., and requires an order of the court.

    According to my papers....

    It is to be expunged, I have to appear before a judge for it at the end of probation. (I wasn't aware that they destroyed files too.)

    I will be happy with what ever it ends up being, lol.
    And lucky too.

    Since I am not considering, nor do I have the ability to consider, a le job I should be in the clear. I guess to me the main thing is being able to vote again.
