    Federal Law

    Sounds like he is in violation of Title 18 United States Code (USC) 2317 and 2318. Which are federal laws related to the sale of piratical and counterfeit media including motion pictures. The actual DVD is considered piratical (pirated) and the labeling is counterfeit. We classify these as Intellectual Property Rights (IPR) cases. It is a big problem, however, the guy selling them on the street would probably not be the primary target of the investigation.

    Most States have laws emulating federal laws regarding the same issue. Most local PD's rarely enforce these laws and may not be aware of them. In Oregon, I called a few PD's and even the State Police concerning an IPR case, which did not meet the US Attorney's guidelines for prosecution and no one knew that Oregon had laws concerning this issue. I ended up passing the case onto the Oregon Department of Justice.

    So, laws regarding this issue probably exist, but reality is, there is not alot of bang for the buck.

    Citation for Failure to have a Class B license (Assuming he doesn't have one)

    I know there is a statute on the books for Commercial Piracy. Matter of fact, I read some arrest paperwork in the station where a detective brought someone in on that. I am not completely sure, but I can find out. DC Law can clarify this a little better.

    Check with US Customs on bootleg merchandise, I think that's one of their areas. The street level info may lead them to the importer.
