    runaway sister crush the car!!!

    My 17 year old runaway sister came back home and stole my car and got into a bad car accident. The car is insure with only me under it and I don't think the insurance company is gonna help. Its also my sisters fault and she only have a driving permit. I know the lady she hit is gonna sue(her car fliped over). Is she still my parents responsibly? My parents are piss and my sister took off again this afternoon. My dad is worry that hes gonna have to pay for the accident. I want to know if my parents are responsibe to pay for her action? And do you have any advise what we should do.

    Ultimately, if your sister did actually steal the car and she was not on the insurance policy, then your parents shouldn't be held responsible for the crash. The lady can still sue your parents, but it probably wouldn't go anywhere.

    Did your parents file a runaway report with the police? It's hard for me to believe that your sister stole a car, drove without a license, got involved in a serious accident, and is already out of jail.

    Was she charged with auto theft, runaway, driving without a license? You're leaving quite a bit out.

    Before the car accident we didn't report her as a runway that time but she does have record from before about this issue. But now that shes gone again we did report her this time. She did get fine for diving without a license. She was able to access the car because she had a copy of a key that no one knew about. We never gave her any copys of the keys because we knew one day she would do this. She probably made a copy for herself somehow. As for beening charge with auto theft I don't know why they let her go. We just got this call from her to go pick her up, when we got there the police told us we can go. I guess the police believed whatever my sister told them. My sister wasn't hurt at all because she was driving a larger type truck and the lady was in a small honda civic.

    In Ca. She would have been sent home with mom and dad because she is a juvenile and the car belongs to the family. I am going to guess that you didn't file a stolen vehicle report?
    As for the civil liability and the insurance the only way to get an accurate answer is to consult an attorney.

    Unfortunately your parents ARE going to be the ones who get sued. Unless she is emancipated, until you're 18 it's the parents who get sued with the minor in tow. Reason is that you can't sue a minor. Sheesh, haven't any of you watched Judge Judy??? In all seriousness, what will probably happen is that your parents and your sister will be sued. If found liable, your parents will be the ones who the judgement is actually against because you can't sue a minor. They then have a couple options. Pay and make your sister pay them back, or pay and sue your sister when she turns 18. They just can't say "Well she's the one who's going to pay" because the judgement will actually be against THEM so if no payments occur it is THEM who the courts will come after. Now, definitely consult an attorney because some of this may vary by location, laws which govern when a minor is actually considered an adult for these situations, etc. Good luck and let us know how it turns out.

    I believe it. We just had a guy who had his license revoked (in other words, was suspended and drove suspended so many times that they revoked the license). He stole a car and got into a high speed chase. Two cruisers were wrecked and one officer was injured in the foot pursuit. The guy ended up being bitten by a dog and hit with a tazer. he also had a warrant. This guy is always in trouble. been arrested several times before and spent time in jail.

    Almost forgot to mention, he broke into a residence while attempting to hide (when the dog finally found him).

    He was released from prison on bail within 24 hours, but no bail conditions were set. I couldn't believe it. Two days after his release he has two more warrants out. And you know damned well that he will run again.

    In the UK, you would have to report the vehicle as being stolen, then she would take the rap for it. If you don't want to say she stole it then you could be prosecuted for aiding and abetting no imsurance.

    You should have reported the car as stolen and your sister as a runaway. Its to late for that now. But I deal with runaways alot. She will do it again. Just take care of things the right way next time.

    I'm still wondering why she wasn't charged with auto theft. Is it your car but it's in your parents' name. Did they give you an opportunity to charge her with the crime and it was declined?
