Question about gun charges

A friend of mine has been charged with several counts, one being Use of a handgun in the commission of a vioilent crime. Basically what had happened was he was a in a car with his brother who was thought to had pointed a gun at a motorist. Now the police never did any searches of the car that night and no alleged gun was found. What is the likelyhood of a conviction in court on my friend or the other occpuant of the vehicle?

Not that you upset anyone....you just aren't telling all of the facts in the case. If you give the whole story than we will be able to accurately give you an answer.

As far as I know this is going to be a trial without a jury.
