with most radars giving a +/- error of 3mph in the manual, i'd fight anything that close to it.

It varies by different courts, in my county it would be a $95 fine and no points for 1-5 over on expressway.
I believe in Florida it will get thrown out 5mph variance

I write tickets all the time for 5 over the limit. I dont actually stop a vehicle until they are 13 over the limit. Writing people for 5 over saves me court time and people feel like they got a huge break, saves them money and points.
