You are not a LEO but do own and carry a weapon via a CPL. 3am roles around and thre are 5 men knocking at your door. You know one of them, but are unsure what the others want. So you grab your gun and holster and conceal your weapon. As you open teh door you see they arent in the best mood and arent stopping by to say goodnight. One pulls a weapon out and puts it next to his leg pointing down. The gun was nevr pointed at you, but could be used for intimidation. So, i lift my shirt so that my gun in holster is showing.

Has either one of us committed a crime so far?

Next the person makes entry to your home, but uses no force. they are words exchanged, but no threats having to deal with the firearms. Now, all of sudden he is holding his gun next to his waist but it is now pointing in my direction.

Now that he has it pointed at me does that allow me to remove my firearm and put it next to my leg without pointing it at anyone? Also at this point has either of us committed a crime?

If somebody comes to my doorand pulls a gun, I'm not going to show them a holster. I'm going to shoot them. I don't pull a gun around my house to intimidate. I'd suggest no else do it either.

Am I understanding this right...a group of 5 men, 4 being strangers; came into your house at 3am uninvited, started an argument and pointed a gun in your general direction?

Your question is incredibly vague and impossible to answer as there are LEO in this forum from all over the country, each enforcing a different set of statutes. I agree with rds and I'll add that even if I know one of them, if anyone comes a'knocking at 0300 they are in serious jeopardy of being shot!

All of us would grab our gun at 3am or anytime someone is at my door I don't know.

Upon seeing someone has a gun, besides ****ting my pants, i'd be doing a lot more than just showing mine. How much faster do you think he can raise his gun before you draw yours? I'd have drew down on him and started yelling commands.

Has either committed a crime? Yes, felonious assault on him (he doesn't have to shoot you to commit a crime) You: brandishment of a firearm at least.

As said, we need more here, how did he enter your home without force at this point? With me he would have to force his way, because I sure as hell wouldn't LET him in. What words were exchanged?

If I came to this house upon your complaint what rings into mind is a drug deal going, or something else criminal, going bad.

Why haven't you drawn your firearm yet? What are you thinking?

i knew of the men indirectly. they were related to the one person i knew formally in the group. i do not own a firearm YET. im in the process of getting one. With a CPL can i draw on him? if so, what kind of orders am i going to be yelling? leave? please leave? im trying to come to a conclusion that if this was to happen again what my options are....

They walked through the door. literally they walked right in my door. They came to find out information about someone else. (Where somone lived, a phone #) There was an insult between families and accusations that a family member was sleeping around and there were tapes of it being passed around. They came to me to find out where the person who was making these comments lived.
