    Summons-violence

    Hi- my name is Regis i wanted to ask a couple a question i was looking around the board nice board

    well i wanted to know are policeo officers allowed to give summons INside a school ? and if yes what type of summons is he allowed to give?

    my last question is - is a police officer allowed to Curse at you and or make remarks about hitting you or taking you down?

    Based strictly upon your questions as asked is the following:

    Yes officers are able to give a summons inside of a school, any kind of summons.

    Yes the officer is allowed to curse at you and make remarks about hitting you and taking you down. You give no details so I will assume the worst case scenario and assume that they had the rights to tell you they would hit you and take you down.

    Police Officers don't serve summonses in Virginia, Sheriff's Deputies do. This will vary from state to state. Where you are has no bearing on being served, so schools are fine.

    As to whether police officers are allowed to curse at you and or make remarks about hitting you or taking you down, that depends. Did they just catch you exiting a B&E with a TV in your hands? Did you have a weapon? Then yeah, they can. :cool:

    lol, no basically i was in the wrong floor in my school and they gave me a summon for "tresspassing" and are they allowed to search me without me comming any crime? in short term are they allowed to give me a search for just giving me a summon?

    I can't edit my post but trespassing is a crime. Maybe they decided to serve you a summons instead of a custodial arrest but could have done either. Either way, consider yourself lucky that you did not get a custodial arrest.

    Next time don't trespass.

    i was trespassing in my own school ? how stupid does taht sound- came in the school legal

    If the school told you to leave i.e. suspension, and you did not, its trespassing. You were issued a summons. That entire issue about whether you were trespassing or not should be taken up with the judge or the hearing officer.

    non of the above its the in my school theres a mini school up in the 3rd floor,but they never informed no one the thats tresspassing because they are part of the campus

    You have moved beyond your question and asking now for findings of law. We are not judges. Talk to your lawyer about these questions.

    Maybe you are not part of the mini-school. Maybe you were caught up there doing things you were not supposed to be doing. I don't know.

    Either way, the issues you want addressed should be handled by a judge.

    It's the same here in Maine, and I imagine it is the same else where as well. Actually, you have less rights in school than you do in the general public. In school, you (or your locker, backpack, etc) can be subjected to searches by school officials. That's not always the case elsewhere.

    Your questions are very vague, so you aren't going to get a very good response.

    If you got a summons, then 'yes' then whoever issued you one most certainly had the authority to do so.

    If you had no business to conduct where you were found, it is trespassing. Don't go places you aren't invited. It doesn't matter if you go to school there, unless you own the building you are a guest. Even if you had a right to be in the school you were in a restricted area. When you go to the bank do you feel you have the right to walk into the vault and behind the teller window? Of course not.

    As to the search, once you are arrested/charged, an Officer can search your, your property, your backpack, your car, your house or wherever they arrest you. It is titled search subsequent to an arrest.

    Schools are normally posted as follows. Ive never seen a school without these signs at every entrance.

    ALL VISIORS MUST REPORT TO THE MAIN OFFICE. ANY PERSON ON THE SCHOOL CAMPUS IS SUBJECT TO BE SEARCHED AS IS THE PROPERTY THE HAVE ON SCHOO GROUNDS ( LOCKER, CAR , BOOKBAG ETC. )
