    Question Can I get a ticket for not letting someone pass?

    hello,

    I have a question, while coming home from school, many people speed and while many times me and my friend we're already going 45 in a 40. While driving home from school people will ride our a-- a lot, and today this girl was wanting to pass us since she was peering over my friends truck and speeding up then letting off when she knew a car was coming.

    But if this girl was gonna pass me and my friend, my friend was gonna punch it since he wont let people pass him when he's already speeding. Even though people still have and they were already going to fast. But could my friend get a ticket (besides a speeding ticket) for not letting someone pass him?

    thanks a lot.

    -Adam

    sigh...

    If I were to see this, both cars would be pulled over and a fistful of citations issued to both. That is the best case scenario.

    The worst case is that your friends actions caused an accident and discovers that handcuffs can be painful and Miranda warnings aren't just something you see on TV when he is arrested for Reckless Driving, Vehicular Assault/Homocide, Reckless Endangerment, or whatever else might apply.

    Tell your idiot friend to leave the enforcement of the states traffic laws to the police.
    Never be afraid to make a difference

    If a vehicle attempts to pass, and the passee speeds up as to not allow the passer to pass the passee, the passee can receive a citation for said action. At least in NC.

    Also, there are speeding, racing, reckless driving issues that can be addressed also. ;)

    Be advised, I'm mean nasty and tired. I eat concertina wire and piss napalm and I could put a round through a fleas *** at 300 yards. So why don't you hump somebody else's leg mutt-face before I push yours in.

    That's more the point than anything and sound advice. The other person isn't going to save more than a couple of seconds and your friend is going to lose about the same. DEFINATELY not worth it for a citation or any of the other listed crimes happening...

    In Indiana it's under the Reckless Driving statute. Free trip to jail.

    Reckless driving; Class B misdemeanor; damage to property; suspension
    Sec. 52. (a) A person who operates a vehicle and who recklessly:
    (1) drives at such an unreasonably high rate of speed or at such an unreasonably low rate of speed under the circumstances as to:
    (A) endanger the safety or the property of others; or
    (B) block the proper flow of traffic;
    (2) passes another vehicle from the rear while on a slope or on a curve where vision is obstructed for a distance of less than five hundred (500) feet ahead;
    (3) drives in and out of a line of traffic, except as otherwise permitted;
    (4) speeds up or refuses to give one-half (1/2) of the roadway to a driver overtaking and desiring to pass; or
    (5) passes a school bus stopped on a roadway when the arm signal device specified in IC 20-9.1-5-14 is in the device's extended position;
    commits a Class B misdemeanor.

    To further this a little, VA now has a law that if a motorist has been signaled either visually or audibly by a motorist behind them, and they don't move out of the way, they can get a ticket for not moving to the right lane (this only applies if a right lane is available for them to change lanes).

    If you're on a one lane road, going the speed limit, you don't have to do squat if some jerk is behind you....but I would suggest calling their reckless driving in, as that could easily escalate to a road rage incident.

    ditto for Texas. i have a tolerance for speeding anyway so i'd go after the one who sped up to prevent the pass. oh that would piss me off to no end.

    Yes, you can be summonsed for not allowing someone to pass. And depending on the situation, you (and the other driver) could also be summonsed for speed.
