    Excluded forever?

    Hello everyone,

    I wrote a more detail post before this one but for some reason it did not go through...

    I've always wanted to be a cop, unfourtunately, I erred and ended up on the other side of the law. I am sure you guys are familiar with the old " She smacked me, and in the effort of blocking shots, I smacked her back" scenario. I've lived to regret my imaturity and the lack of forsight. I was only 18 years old at the time, and sincerely did not mean for things to get to where they got... I've been fairly successful in the workforce, but there is a disatisfaction in what I do despite the financial rewards. Months after the incident I met with my local Beat Coordinator he advised me that it would be near impossible to achieve my goal given the nature of the charge. Although it was filed as a misdemeanor I am precluded from applaying for the the job. In your experience, what would be the chances for becoming a LEO despite the stated.

    so was the charge domestic violence? If so, you are going to face a hard road getting picked up by a department. That is a DQ for most if not all departments...

    Most domestic assault or domestic related charges will keep you from getting hired at most LE agencies. If there is any chance in getting it expunged, I would check into it. Best thing to do is get with an attorney and find out. ;)

    It was, Domestic Violence. At the time my attorney said it would be no problem getting it exponged. It is the fact that it is an automatic DQ that is a bit hard to swallow...

    I hate to say it, but in CA no agency will hire you. You are prohibited from owning a firearm as well in CA.
    Be advised, I'm mean nasty and tired. I eat concertina wire and piss napalm and I could put a round through a fleas *** at 300 yards. So why don't you hump somebody else's leg mutt-face before I push yours in.

    I'm not entirely sure with an expongement. I can't remember if on my background if it asked if you ever been convicted or arrested of DV.

    There is a BI on here, he might be better able to answer.

    Since I can't edit my original post. Even if you had it expunged, you would still have to notify your BI that you were arrested for DV.
    Be advised, I'm mean nasty and tired. I eat concertina wire and piss napalm and I could put a round through a fleas *** at 300 yards. So why don't you hump somebody else's leg mutt-face before I push yours in.

    What was the final disposition of your case? Were you convicted? If so, what was the original charge?In some states, expungement only applies if you were not convicted in which case the record of arrest and court records would be expunged.

    Correct me if I'm wrong, but you can own a firearm with a domestic violence conviction, you just can't buy a new one for a period of time. Firearms at the scene of DV can be seized for 72 hours pending a hearing. CA law does state that you cannot possess a firearm if you have a domestic violence restraining order against you. I'm being to lazy to do the rest of the penal code research.

    As far as getting a police job, I know DV and DUI are huge hotbuttons for most CA depts and the chance of getting hired in CA with a conviction is pretty slim. I guess the circumstances related to the crime would have to be scrutinized....we'd need to know the actual conviction, all of the facts related to the act, officer's statements, injuries to the victim etc....Also, it would be hard to ever face a DV suspect in court if you had a DV conviction yourself. If you don't think a defense attorney could find that out and bring it up in court you're crazy.

    In Oregon, expunged is gone. The records are destroyed, not sealed. You could say that you'd never been arrested or convicted. That's the idea behind expungment.
