    Unsafe lane change count on your record in CA?

    the citation i got is something like 21658(a) for unsafe lane change. although i dont expect to win if i was to fight it but this is something i rarely do anyways.

    here's what happened:

    10:00pm on a weekday. this is in California and on a 3 lane street. i was in the middle lane and lane changed into the slow lane. nobody in that lane at all and nobody was behind me for at least 100 yards. then after driving for about 100 more yards, the police officer sped up and got behind me, which he was in the middle lane too and ironically did not signal to get into my lane. he followed me for 3 signal intersections, which i estimated to be about 1 mile (underestimating this too, these are long intersections, i.e. car dealerships and strip malls on the side, to be precise, we passed 1 dealership, 2 strip malls, black angus, and albertson's). he didnt put on his lights until i made a right turn into my apartment complex (which i signaled). now i didnt lane change fast or anything, just a normal lane change except without the blinker. on my ticket he even clocked me at 35 in a 40 mph zone. but he did put down the street he pulled me over on and did not put down the street where i made the violation.

    my guess, he was fishing for a DUI. but my main question is: does this unsafe lane change count on your driving record as a point in California? i can go to traffic school for this but i went to the DMV website and could not find the citation number on their list of 1-point voilations. or does anything think i can really fight this ticket?

    i'm also a law enforcement major working for my AA degree. isnt that ironic.

    How can you be so sure you could fight & win on this violation? You clearly admitted in your rambling that you did make the lane change without using a turn signal... I'm lost on the basis of your defense?!?!?!? :confused:

    It is a moving violation. So 1 point on your record. But once you go to traffic school, It is gone, but you do have to still pay the fine and the traffic school costs.

    i'm not really trying to fight this. i just threw in the question on whether or not its possible. who knows, maybe someone sees something i dont. my main question is if this counts as a point on my record or not because i cant find that violation on the DMV website saying it is 1 point. all other violations are there except this one.

    Why don't you CALL the CA DMV or your local PD and ASK them ? You may get some well intentioned but NON LEO responses here that don't deal with points like the DMV does.

    Hmm..I'm a CA LEO and I have no idea what infractions give points. Just like I have no idea what fines people pay for infractions. I write the tickets, the courts/dmv deal with the rest.

    21658(A) is a moving violation and goes on your driving record as a point. As mentioned above you can attend traffic school if your eligible. If you've attended traffic school within the last 18 months you're not eligible. Also if you contest the ticket and are found guilty, you're ineligible to attend traffic school.

    Basically anything you do driving will go on your record as a point. There are some like seatbelts and other equipment violations that go on your record but not as as point. Then there are correctable violations which as long as you take care of them and don't FTA on them, won't go on your record at all.

    A general rule of thumb is if you do something while driving...that's gonna be a point on your record.
    Be advised, I'm mean nasty and tired. I eat concertina wire and piss napalm and I could put a round through a fleas *** at 300 yards. So why don't you hump somebody else's leg mutt-face before I push yours in.

    I had always heard that. I guess the court system down here does not look at it that way. They hand out Traffic School like like it is going out of style. Oh well.. I dont care. I am usually there in my suit, which means 4 hours of O.T.

    ya i saw that part. but the citation number i got doesnt match that. i would figure that all moving violations are one point but its weird that this 21658(a) doesnt show up on that DMV list.

    i tried calling the DMV but was on hold forever. i'll just try again some other time.
