    Survey markers

    We hired a surveyor. He measured our double lot, painted marks, put up small markers (flags). This morning 2 front flags were gone and the orange paint was painted over in black. We know who did it.

    Should I call the surveyor and let him handle it, or should I call the police? Is there anything I can legally do? Its not really destruction of property. Not really tresspassing since you don't have to stand on our property to remove/cover these things.

    I'm not a cop (yet) but I've been in this kind of situation before. This is just personal opinoin, but in situations like that, it's best if the person who has been taken advantage of/wronged would take care of things. If the surveyor wants to call the Police and make a complaint, that's fine, and it would probably end up working out better.

    I would try dressing up in all black with a ski mask and go over to there house at 2am and break down the front door with an axe. Once illegal entry has been gained, spray black paint on all visible surface areas. Should the neighbors awake in the midst of all this madness, simply charge them with the axe and tell them that if they harass "the people" across the street anymore, they will be dismembered and disposed of at a nearby hog farm, same goes if they contact the authorities. That should prevent any further attempts at property destruction or any harassment. If the police DO get involved, then you may be screwed. But it might be worth a shot!

    Go pound a 1 inch piece of metal pipe about 2 feet long into the ground at the appropriate mark. If your neighbor continues, call the police.

    The surveyor did.
    We thought kids just ripped up the flags until we noticed one marker was painted over.
    We called the surveyor, but we haven't heard back yet.

    What legal charges could be filed? :confused:

    I have no idea, but why the pettyness (on their end, no one better try to say I'm defending them) ? just angst in the relationship between you guys? I must have missed the earlier threads since you mentioned they've done something before.

    I have no idea. I think he's a drunk bully who is used to pushing people in the vicinity around and we don't bother with him. We just call the cops.
    I also know my husband has a 'history' with the man's wife (before they even met and before we even met, so I could care less. Not sure if sex was involved, but they have known each other since high school.)
    Anyways, he complaines about the height of our hedges, the color of our garage, the noisiness of our kids playing in the yard, etc. He'll just sit in his yard bellowing at us drunkenly from across the street. It did tone down a bit when he got married.
    I think he say a childish way to get in a 'dig' so he did.

    But was it illegal to do what he did?

    File this under "Useless Things to Know" :D

    It's an offence in my State to interfere with the work of a surveyor and that includes mucking about with the surveyor's pegs and equipment. I would imagine that there would be something similar under Michigan law.

    You paid for a legimate service to be done. He damaged or attempted to damage it. It could be classified as criminal mischief ( vandalism) or harassment. Can you PROVE he did it ? Knowing is one thing, proving is another.
