Texas law - is this illegal or criminal?

I have consider many things - like asking him when the next show was so I could sell tickets. FWIW, it would be a small show.

I'm fairly sure if he thought I knew, or if I were to say something to him, he would stop - I just wonder if that would cure the problem though - it might just force him to take the next step and try to get physical.

Part of me says just blow it off - part of me says just move - part me wants to hurt the guy.

I go back to my original concern - without any hard evidence (no pun intended) what can the SO do and what would really happen:

1) It will turn his life and our lives upside down - probably the whole neighborhood, and in the end, 2) he may still resort to taking it to a physical level thinking if he's going to be accused of it that he might as well do it.

Then I have to sit back and think about things in a more rhetorical fashion - what keeps anyone from saying something similar about anyone else? In our society, the accusation can sometimes be more damning than the truth - although in this situation, I know what I saw.

I called the SO and talked to the Sgt who wanted to send an officer out and take a complaint. I refrained for the moment as I want to talk to my wife about this - I will get her to read this thread as well. This is a serious step in a serious situation, and I don't want to jump into it lightly.

Again - I want to thank everyone for their insight and comments. I was about to burst wide open, so I am very thankful for forums like this and the opportunity to get it off my chest.

If I may be sarcastic a moment; don't bother to cause yourself any more grief or be put out by this any more than you already have. and after all, he may retaliate.

sarcasm off. Thats how your last post sort of read to me. And if you do nothing, and he sexually assaults someone else because he was not caught and punished, how will you FEEL then?

I am not trying to bust your chops here, just a different approach for a different POV.

And Mystic; your idea would be ineffective at least, and if he thought his behavior was being approved of, he would most likely have to step up his illegal behavior to get the rush he is looking for.

If I may, I would suggest having a deputy come out to talk to him. He most likely wouldn't get arrested at this point because there really isn't any evidence. The deputy would most likely give him a good talking to that would scare him straight. I suggest you have them do this before it gets worse. He obviously is mentally ill and there is no telling what he will do. I seriously suggest having a deputy have a talk with this guy. Don't worry about retaliation, there will be a paper trail if you have had a deputy out. Don't let him interfere with your life. Good luck.

I would not be so worried about messing up his life. If his life was to become messed up it is his own fault. He is the one that is messing up your family's and your life. Do not feel any pity for him. He is the sick freak that is doing this. There is a cause and an effect to any action. He caused you and your family to feel unsafe, disturebed, ect., and the effect should be him getting in trouble with the law enforcement. As you have said, he could go to other worse actions. Since he is already mentally ill you never know how far he could take it. Not to mention the poor kids that you said your neighbor has. What if he exposes himself to them? The best thing to do would be have an officer come out and take a report. This will get him into the system and as Metallic4 already said, there will be a paper trail if he does something else.

To sum all of this up, put you and your family first, not this sick freak and his life.

I agree with tx, allowing this perv to continue because of what he may or may not do next is the wrong approach.
You can control what you do about a situation, not what someone else does.

And why should you have the expense of putting up a new fence ?
He should have to flip the bill for it since it is his actions that require the need for it.
A repeat of what others have already said, start the ball rolling by making a phone call to your local PD.
Then get a hold of a lawyer to file a law suit.

If there was a guy like that around here, I would be absolutely pissed to find out others had seen this and not reported it.

Well, as fate would have it - none of the www.johnsoncountyso.org contact e-mails work - nor their contact form - all returned with an error in delivery.

of course they don't work. the guy who has their contract has his business in my city. kind of a bonehead.

call johnson county SO. and tell him to stay in johnson county. bunch of gimps down there. i live off 1187 and don't need them any closer.

you need to call them when he's actually doing it, but i'd still report what has already occurred. they can go ID him and then get a statement from whoever in your family saw him. i've arrested plenty of sex offenders and they usually start out small like that. right now, he's just building up his courage and eventually, he's going to want something bigger and better than what he's already doing. if he doesn't have a history already, he needs one.
