I am a college student studying administration of justice at my local JC. I need to write a paper about Police Discretion. Any and all replies will be very helpful. Thanks!

DIscretion is when an officer has a situation in which he/she CAN take different courses of action from verbal warning/ticket/criminal arrest/ "evicting" etc as the situation dictates and yet uses information that he knew previously or has just discovered to use in making his final decision.

The most common form of officer discretion is whether or not to arrest someone.

In my state , are FEW laws in which is it stated that I MUST arrest a person who commits an offense.

If I stop a single mother working 2 jobs to support her 3 kids with a husband who walked out and doesn't pay child support, I may use my discretion in deciding to cite or not.

If I go to a domestic situation , I may decide to tell one party " either you leave for the night or you are getting arrested" .

I typically use my discretion in a way to get someone to comply with me in a manner that doesn't cause an arrest and yet accomplishes getting my point across.
