This guy I know told me a story about this girl he works with. She said that a person she knew hid in the bushes near her sliding door and took revealing digital pics of her and her BF. The pics ended up on some yahoo group. She found this out from another friend who had heard rumors about this from work. When she joined the yahoo group to see for herself she was horrified at what she saw. Anyway not wanting to go into the whole story, is there a way to press charges on the creep? He works with her and he also is friends with a few of her friends.

Problems, the guy of course denies everything. He wasn't even the person that posted them in the yahoo group as he claims he doesn't even belong to one. And they can not tell who got the images first, etc... The reason why she is almost positive it is him is strictly hear-say and the fact he just bought a brand new cam from Best Buy two weeks ago.

I have no idea how she can really pursue this without concrete evidence. Is she out of luck? Curious.

A lot of depatments now have hi-tech crimes divisions that work on these kinds of case. Call your local PD / So and talk to them about it.

i'll tell this guy to have her call the PD but from what I've heard she won't do it. she's really embarassed by this.

I would go to your local P.D's office and ask them what can be done. I would also try to set him up by doing the following:
Tell your friends at work that your b/f is coming over for a relaxing evening etc..
make sure he is nearby and hears it but dont act sarcastic about it. Hide a video camera outside and pray he comes by. This way you have video proff. Hey its just an idea.

Anyway he could take a poly or does there need to be some sort of hard evidence or probable cause before that can take place? Wonder if he has any of the pics on his personal pc?

If the peeper continues his peeping after being accused of it, then he's an idiot and deserves to be caught.

Now, if you had grounds for a warrant then the police could look for pictures on his camera and computer. File dates would prove if he had the images before they were posted to yahoo. Having said that, you need something concrete to get a warrant for that. The police in your area could advise you better.

Right now I would put up motion-activated lights outside your house so nobody can creep up to your window... And make sure your curtains are closed! If you can ID where he was standaing then maybe check for evidence left behind, like footprints in a flowerbed etc. The police can advise you if there is anythign they can do.

If you want to pursue it civilly then get hold of the person who posted the images to yahoo and have your lawyer send him a nastygram. Just because you can't prove he TOOK the pictures, he posted them, and that should be enough to get him into a courtroom. Offer to drop it in exchange for an affadavit and testimony identifying the person who took the pics. If he can't or won't ID, then See Ya In Court, Sonny. You'd definitely need a lawyer to explain what kinds of damages can be claimed and what can be argued int his case.

Just a thought... My Toshiba Digital Camera has a 3-digit index number that it uses to sequentially number images. Images come out as image000.jpg, image001.jpg etc. If the guy was stupid enough to leave the raw filenames in places then you will have an index number to compare to his camera. If the index number on his camera is higher than the index number in the filenames, but not significantly higher, then that would suggest that his camera COULD be the one involved. The index number is easy to see on must cameras and he may even hand the camera over for a cursory glance by an officer who could see the index number... If his camera's index number is lower, or significantly higher, then that camera is probably in the clear.

When you format the SmartMedia card in my camaera and delete all the images then the index number is still preserved. If I have images up to image145.jpg on the card then I format it, then the next picture is still image146.jpg. There is a special menu option for resetting the index number back to zero.

i think this girl doesn't care much because of the embarassment. she did not save any of the pics after she viewed them because she was so disgusted. Her BF did not either. They knew exactly where the person was hiding outside and have since replaced the blinds so that they would close completely. other than that who knows. hopfully she will pursue legal action somehow. but she seems more concerned with "saving face" than going after the accused.

should be noted it is an apartment complex so there would be no way to get motion lights installed. She shares the apt. with another girl so the other angle is her roomate might have been in on this. There are so many angles to this story...
