    Question POP radar tickets?

    I read a thread at http://glocktalk.com/showthread.php?threadid=234871 where an officer said that he would not issue a ticket based on the POP mode because the manual said this reading was not realiable. The V1 web makes a great deal of this last point as does even Escort and others that, unlike V1, report Pop alerts

    By Pop radar, I mean like the MPH Industries model BEE IIItm Pop mode not the InstantOn version normal K, Ka, X, or lidar.

    According to a poster in rec.autos.driving, his V1 gave no warning when he got a Pop ticket on I-44 in OK from OKC to Tulsa. He claims to have engaged the officer in a discussion about Pop then tried out his V1 with a friend in law enforcement with Pop radar.

    I have been trying out the spec mode of an P8500 X50 and got Pop alerts on I-44 and I-35 in OK (the V1 was always silent). According to http://www.detectortest.com/article.asp?articleid=9080 Pop radar was in use in at least FL, MS, Montanta, OH and WVa by the end of 2003. In one particular online forum, others have reported Pop in GA, NV, NJ, and NY.

    With the growing use of pop, how often are tickets written based on Pop despite the instructions of the manual? And if someone is stopped by Pop, do they have the right to discuss this with the arresting officer? This is the advice given at http://www.valentine1.com/moments/mom1103.asp but I have seen online threads where LEOs say this kind of response is inappropriate.

    And if a ticket is issues based upon a POP reading, can the driver prove that is WAS a POP reading? ie does the BEE III have a normal mode?

    If you rd gives a Pop reading and you see nothing else, then presumably regular K or Ka was not used to get a reading.

    Since the manufacturer says that the device is not reliable in POP mode, I am asking LEOs about the correct protocol to clarify a radar reading based solely on the POP mode.

    November 2003: POP goes the Bee!
    On this site I learned of the MPH Bee III and it's weaseling sneak mode.

    Then I got "popped." I had no idea that it was by the Bee, and certainly no notion that it was the underhanded POP mode. But, as is my habit, I was simply exercising my right to see all evidence. You'd be surprise how often they clear the display before letting the target go. No display, no citation. When I asked to see his radar equipment, behold and tremble, he's got MPH's latest!

    After confirming that he had used the POP mode, the man who wanted to take home my take-home pay was rather surprised when I referred him to his book—in the glovebox and apparently still virgin. In it we found the "note of caution" which Mike had quoted on this site.

    As he read the words "non-evidential" and "citations should not be issued based solely on information derived from the POP burst," he mumbled something I didn't quite hear. Whatever it was, I'm sure you wouldn't be able to print it here!

    I got a V1 2 weeks ago without POP using a standard Genesis handheld. LIDAR should be scarier to you than any RADAR device, with it's ability to specifically target a vehicle.

    The last citation I got was 18 years ago on I-40 in AR. Since I was passing through the state, it was not reasonable for me to return for a court appearance. This happens to have been a case where I would have liked to ask to see the captured radar reading since the actual speed in question was in dispute.

    So my quest here is to simply clarify my rights in this situation. If it matters, I happen to personally agree that lidar, InstantOn, StalkerVision, et al, should be used against agrressive drivers that threaten the safety of all concerned.

    SO what are you going to do if you drive through my area and I snag you on infrared ESP or vascar ? I LOVE it when people complain about their detectors not working when we get them.

    I call BS on an officer actually getting a manual and perusing it with a violator.

    Can someone tell me what POP is?

    Unlike BEE III POP, the discussion would not start with a request to verify captured radar reading.

    Thank you for answering my question.

    In Texas, you would not even know what type if radar was used until you arrived in court, or your attorney filed discovery. There is no requirement to show a violator the radar unit.

    I would not have a roadside discussion of radar with a violator, and I certainly would not offer him my evidence.
