OBP, can a new warrant be issued? Or does it become leffectively like a statute of limitations whereby if the guy isn't caught with X years, he is free. Can you charge a person in absentia if you have enough evidence but he is a fugitive? If he stays on the lam long enough for the warrant to expire then can he just waltz in to a cop shop and stick twos up at you? Or can a new warrant be issued?
(Of course, as I understand it the US the S of L applies to crimes for which the person has not been charged... Once you are charged/indicted then that time limit no longer applies and the only time limit in force becomes that of the right to a "Speedy Trial". Is that correct?)
Not all of them run out, only the less serious ones. You cannot charge someone unless they are present to be charged, you can however issue a warrant if they fail to turn upto the police station to be charged.Originally Posted by Scruit

So when you release someone with a promise to appear then you can issue the warrant if they fail to? Now if they stay on the run until that warrant runs out then are they free to go?
That would be scary... Is the time limit long? I mean who's gonna want to be on the run from the police for 3 years to avoid a shoplifting conviction that's only gonna get them a small fine anyways?

I have never seen a delony warrant that expires. I know that there are no federal felonies that expire... or at least, in more than 8 years, I have never seen of or heard of one.

In NV, the statute of limitations applies from when the crime occurred/discovered and when the state goes forward with the charges. If a warrant is issued within the limitation period, then that is it. It does not matter how long the warrant is out there and when the loser gets picked up.

I have never heard of a federal arrest warrant with an expiration date.
The only caveat to that is we occassionally will ask a judge to have a long standing warrant dismissed when we think we can't prosecute the case any longer, due to missing or dead witnesses, or something similiar.
Federal search warrants are only good for ten days after the judge signs them. They must be served in that time period or you have to take it back to the judge and reapply.
Our misdemeanor warrants are good for 180 days, though they only need be re-issued. Felonies last a lifetime.
The only limitation for misdemeanors is that they have to be charged within two years of alleged date of offense. The warrant would be good forever as long as it is taken out within the two years. Again, Felonies are forever.

MIsd and Felony warrants are good until we drop the charge. Traffic warrants are different and it depends if there was ever a plea entered to begin with. I picked a guy up on an 11 yr old traffic ticket. He just paid it and went on his way.
