    Stop Sign Violation Question

    Hey guys-

    This past saturday night, I was pulled over by an officer. I was coming off a sidestreet and was taking a right, and I didnt come to a complete stop. LIttle did I know the cop was traveling in the same direction as I was turning to. Heres my question:

    Prior to this, I have had one Warning (speeding, 51/35)

    And I rearended someone (it was slippery and raining) I got a warning for following to closely...

    And I got a $100 ticket for Failure to stop at a sign (clearly no sign there for the record).

    My insurance went up 3 points for the minor accident, will my insurance go up one point or does it not effect it and I just have to pay the fine. Someone told me about SDIP (safe driver points or something). Any help appreciated. Thanks a lot.

    Take advantage of any SDIP or Defensive Driving class the court offers.

    Any moving violation may result in points on your license or a raise in insurance rates.

    look on the ground in front of you as well next time. if there is a yellow/white line with te words STOP written on the pavement, stop.

    Theres no sign, and no line indicating to stop.

    well, then get a traffic lawyer and fight it in traffic court.

    Well you mentioned that it was during the night..I'd probably go back and just make sure there "isn't" a stop sign or any line. Don't want you to feel stupid or ignorant when you try to fight the citation and there was a marking all along. Let us know your findings.

    I am positive becasue I drive there every weekend. It is the road that leads to my cottage that is on the water.

    However, does that make a difference if there is no line or stop sign?

    The only other problem I face:

    When he walked up to my car, he said "You are being recorded", "Do you know why I pulled you over". I said "Yes Sir, I didnt come to a complete stop and rolled through".

    Could that hurt me or do you even think they bother to bring a tape recording for a minor ticket like this. Thanks again!

    In my state if there was no sign or signal you wouldn't have to stop. Don't know about Mass.

    Eventhough I kinda directly admitted I was supposed to stop, woudl it make a difference in court since there is no sign or line? I just want to know what im doing when I go to fight it.

    I was also told I could take a defensive driving course and my insurance wouldnt go up, is this true also?

    there are probably lawyers in your area that specialize in traffic law and traffic courts. my best advice would be for you to ask him those questions.

    I bring tapes of my stops to traffic court. Usually the violator has something to say to me about the stop while I am talking to them. Also, when I am working stop signs or red lights, I have my camera running the entire time I am working the intersection to show the court just what I saw.

    Take a picture of the intersection to shot there is no sign or stop bar.

    Check your state laws, I don't know about where you are. The code number is usually on the citation, and most states traffic codes can be found with a quick internet search. It would probably help to know exactly what type of stopping violation you were cited for, here in my state there are several places you are required to stop even if there is no stop sign or stop line painted, including entering a highway from a private drive or street, where you are required to stop before the unmarked crosswalk or intersection.
