    DUI Arrest

    Okay, here's the scoop. Someone I know just got arrested on Saturday for DUI. She had blacked out while driving and ended up in a ditch. When the officer approched the vehicle the she was passed out cold. The officer noticed the vehicle was still on and still in drive. When the officer attempted to wake her, she cussed him out. She then got out of the vehicle and failed all sobriety tests...almost fell 3 times. When the officer attempted to arrest her, she became violent and began kicking him with steel toe boots. Once he had her in the patrol car, she started cussing him and began kicking the windows of the patrol car. The officer pulled over and had to restrain her with shackels. While in the holding cell, she continued to cuss each and every person that walked by.

    I bet they couldn't wait to get her out of there!

    She was charged with 6 things:
    DUI
    2nd degree assult to an officer
    no seatbelt
    tags weren't current
    attempting to operate vehicle...I guess because the vehicle was on and in drive

    This occured in Maryland and was her first arrest. What typically happends with a situation such as her's?

    Any information you have would be greatly appreciated

    Wow...doesn't sound good...but maybe bc its her first offense...they will cut her some slack. I guess alot would depend on how much REMORSE she has when she sobers up and shows up court.

    I'm sure some LEOs here will be able to give you some answers.

    No offense, but she should not recieve any slack. DUI is very serious and shes lucky she did not kill anyone or herself. And then to top it off threatening the officer etc. and being disrespectful isn't good either.

    She definate has remorse...she feels absoutely terrible about the whole thing. Needless to say she is scared out of her mind.

    And no offense taken...DUI's are very serious. I have young children and the thought of driving is very anxiety provoking now. God know who is on the roads....scary! Her attorney thinks she may serve jail time, not because of the DUI, but because of the assult.

    Yeah, as long as she knows what she did was wrong and is willing to pay the price. Good luck to her.

    Agreed. We all make mistakes, and some mistakes are bigger then others. If she shows true remorse for what she did then I hope she gets a fair ride through the justice system.

    The best thing she can do right now is listen to her attorney. Sounds like she's doing that. Good.

    Yeah, I figured as much. Whats worse...DUI, Assulting an Officer or refusing the breath test? I guess it doesn't matter..it's all bad.

    Does anyone know if police in Maryland record the traffic stops? If so, the scenero just gets worse.

    The ball would love to have her I'am sure.....around here we're calling her the chicken lady.......she's tall and skiny...and the best part READY? When she was arrested she had 2 dogs in the cab of the truck and a cage of chickens in the back. I'am sure she was quite the joke of the station. This really isn't funny...stop making me laugh!

    And no that wasn't going to be the last line.......she's even worse off if the arrest was taped...she almost fell down numerous times, not to mention all the kicking of the officer. YIKES

    In Minnesota thats an automatic 1 year license revocation. I've been involved in two dui's on ride alongs and in both cases they refused to give a breathalizer. I just shook my head, I wanted to say...man, your just screwing youself even more.

    Sorry Scruit, a mistake is when you bump into somebody with your grocery cart or accidentally write a rubber check...

    Getting trashed out of your mind, driving or attempting to do so while endangering EVERBODY on the road, kicking ( assaulting) a police officer, trying to damage the cruiser, refusing the BAC test are NOT mistakes. They a group of incredibly stupid criminal acts in which she is 100% on the hook for. I certainly hope she gets jail time.

    In PA , she would lose her license for 18 months, do mandatory jail time even without the assault ( a felony here).

    She does need a lawyer though so she can properly plead guilty to everything.

    In Texas she would have her license suspended and probably receive some type of probated sentance on the DUI, then the others would be reduced to time served or dropped altogether.
