    class one misdemeanor

    Hello everyone, I have a question. My friend whos in the Marine Corps was driving back to base on I-95 and passing through viriginia when he got pulled over for speeding. The cop said he got him doing 120 in a 65. My friend said there was no way he was doing 120 and can get a document signed by a certified mechanic saying that specific car will not go 120mph. He ask the cop how he knew he was going that fast an the cop said he was driving behind him. My friend thinks that the cop had to do 120 to catch up to him and was still doing 120 when he flicked on his lights to pull him over. In viriginia anythign over 80mph is reckless driving and is punishable with a maximum 1 year jail and or $2500 in fines. His court date is coming up next week i believe. What should he do!?

    General rule: If your liberty is at stake, you hire a lawyer. Jails are full of people who thought they could represent themselves...

    Similar situation actually happened to me in Ohio, as I was driving between Michigan and Georgia.... Although... I didn't receive a ticket. I admit, I was speeding. The speed limit on I-75 SB was 65 MPH... I was probably doing 75 mph at the time. The Ohio Highway Patrolman was NB on I-75 and observed me "flying by other vehicles", so he turned around to catch up with me. When he approached, he indicated that he had to go over 100 MPH to catch up with me, and that I was going at least 90 MPH.... Simple mathematics tells us that if I was going 75 MPH one way, and he was going 65 - 75 the opposite direction, we're departing each other at about 150 MPH. One would obviously have to drive FASTER than I to catch up with me.

    The real moral of the story, I guess... I broke the law, and probably should have received a ticket. I'm thankful that I didn't, but.... each of us make decisions when we drive, and we choose to speed. For that choice, there are concequences. And the concequences of your friend's actions are severe. As the rest of the posters indicated, hire a lawyer... When it comes to money or freedom, I'll choose freedom.

    Same goes for Texas drivers in Louisiana,

    All those drunks heading back to Houston from Lake Charles and Kinder are easy pickings.

    FYI: Do not be a Texan pulled over in LA, you will not pass go, you will not collect 200.00 dollars, you will go to jail. They will sort out what they are chargin' ya with in the mornin'.... Seriously, I was held and detained because I LOOKED LIKE A GUY on a wanted poster. I had 3 different types of picture ID (a federal employee ID, A TX DL, and another employee ID from USA, a contractor for NASA). Their response, "Ya Texans sure are slick" Ok, I'm a nerdy computer programmer, going to see family in New Orleans, with a prosthetic leg, how am I a BANK ROBBER?

    yah I just hopped in , and robbed the place blind....
    I disapprove of what you say, but I will defend to the death your right to say it.
