    Traffic stop-disabled.

Just a quick question, input from anyone would be most appreciated...

Anyone's dept have specific guidelines regarding disabled persons? I am an Above Knee Amputee.

Usually if I'm not wearing my leg, they insist that i stay in the car. I am assuming because of my leg. What if they wanted to search?

Would they force me to "hop" and stand on one leg while they search?

    Just curious...

There's always a way around something. Adaptability in this field is a good trait to have. If I needed you out of the car you would get out. If you had to lean against the car or place you in my backseat, whatever would work.

Well i was wondering what the specific guidelines were?

Isn't there are a lot of room for liabilty there? If I get hit because I fell because the officer requested I remove myself from the car, would the dept be liable? Would the officer be liable? Would they both be any more liable that if the person hit was not disabled?

I guess what I'm trying to say is, are their actual guidelines that govern the specific handling of disabled persons? Like how to arrest them etc....

Does your dept have ADA guidelines?

This is not a crack but some people worry too much about liability. We have had to adapt to ALL kinds of situations in dealing with all kinds of people. We would manage just fine.

If we can deal with a drunk who can't stand , we could handle an amputee who is ( hopefully) sober.

Whether or not the ADA "Harmed" america is neither here nor there,

I asked if your DEPT had specific guidelines in regards to that...

I did not state I was unable to exit the car, if I'm driving, yes I can exit the vehicle?

I don't think you are seeing the point. I take great offense at being treated differently, and as such am wondering if I would be treated differently during a stop..

Dc Law, the hostility is unwarranted and quite unprofessional. You won't care, but I still feel the need to state that. Your statement that "I've caught more than one wheelchair user and amputee hiding drugs or stealing" was totally unfounded and uncalled for.

I never stated disabled person did not violate the law. I only asked a question in regards to those guidelines.

WE do not have any guidelines for you. There CANNOT be guidelines for every conceivable situation out there. Sometimes we just have to use common sense. I arrested a guy in a wheelchair for DUI. It wasn't a problem. I am sure that you would be able to get out and move where I asked if I needed you to do so.

I do understand what your saying, I despise anyone using their disabilty as a "crutch" so to speak..

You searching me would not offend me in any way, shape, or form.

When i fly, The TSA ALWAYS brings me into a back room and forces me to take off my prosthesis. I don't like it, but I understand the reason.

The ADA does not apply to the way LE agencies treat Violators/suspect/Contacts

There are many cases LEO's being injured and killed by people with disabilities because the officer assumed the person could not be dangerous.

My agency had no specific guidlines for this situation.

CashCrop, your supposed 'misunderstanding' is veiwed here as a matter of a 'reason to be mad' in this LE's opinion. Get over it, if you are breaking the law , and a search is warranted , it will be forthcoming. I quite agree with DC and mc, in that i have arrested wheel chair persons, as well as people with only one arm ( that i cuffed um to the rear, by their rear jeans belt loop). Get passed your 'disabled' status, unless, of course........you wish to use it as a defense.

Some of my best street use size drug pops came from disabled drivers. I have also got my share of guns out of the cushons of wheelchairs. I pull them out just like a drunk, assisted and use caution.

surely as in all stops first and foremost....common sense prevails....
