This is NOT a person you can talk to. He is a 50+ something yr old child. Last time he had every neighbor he has in an uproar cuz he was trying to mow his lawn drunk at 10pm on a school night. He doesn't work, he just gets drunk everyday on his pension. All day to mow the lawn and he does it at 10 pm. He will tell you that you are trespassing if you stand on his sidewalk to get to his door.

Is the curb legally mine or it is the villages'? I was wondering if it was tresspassing or simply littering. If its littering, than I am doing the same thing when I leave my branches at the curb.

    Jynx, what did you do?

If y ou don't have a large dog, get one. Then....feed him several cans of Strongheart dog food, take him for a little stroll through the neighbors yard. Doggies love that stuff, neighbors don't. LOL :p

I called the police and told them that at the moment I was being calm...but that if they were not at my house in 5 minutes I was going to set it afire! They showed up rather quickly and upon seeing them my neighbor quickly ran out of his house and began removing his trash.

We don't have tresspassing laws were I live, but if you live in a city..the curb belongs to the city.

Orleander, the sidewalk is typically a city maintained article(one that the city may enter 'onto' in order to do maintinance(i.e. repair the sidewalk or repair). However, the specific point you have is valid......."is it one of tresspass or littering?"

Good point, i would suggest you ask your local authorities and let them give you an opinion. I would assume it is a matter of litter.
When YOU leave articles of rubbish such as yard waste, it is not litter, it is yard waste legally given over to a city entity to pick up... and dispose of.

Call your local authorities, and have THEM confront this individual.....this will take you out of the equation. If this individual is as you have stated he is, he is looking for a fight.......and without a figure of the local government interveining.....he will continue to be a problem.

As per your question of his late hours of lawn care..........most jurisdictions have 'noise ordinances' as it pertains to construction, and lawn care(ask your local police personnel of this point , and how it pertains to you).

DUI is one of the two driving charges I can make against someone on private property in my state, and as long as it has a motor you are eligible. I would sick the cops on him everytime he mows his lawn...as long as they can charge for that there.

His girlfriend disconnects the mower part so he's basically just driving around his yard. Viewed from above I bet it looks like a pinball game.

That's funny, but it wouldn't matter here. If it has a motor and he's in actual physical control of it, he could be hooked up. I have a lot of funny stories, living in a fairly rural area.
