Trash is fair game. It has been abandoned and may be searched, assuming you do not need to enter on someone's curtlidge (sp?) to access the cans.

Anyone who is stupid enough to throw their seeds, stems, roaches, zigzag packs, and trim into the trash, when they have a grow op, deserves a nice long state funded vacation...
adleast have the common decency to burn the stuff...

It's kind of hard to not throw stuff away that indicates when you are conducting large scale growing, meth lab, heroin cutting, whatever. And, whenever you are on surveillance and you see some doper go throw his stuff away in a local dumpster, you know you want to dive in as soon as he leaves.Originally Posted by CashCrop
It's like trying to beat wiretaps by only meeting other criminals in person. That sounds good in theory, but in real life, it is impossible to do unless you are a very small doper.
Large scale marijuana growing, meth labs, etc. is like any other crime, you can get away with it until you are noticed. Then it's just a matter of time, regardless of how you are finally caught.

According to Federal Law this is correct, however some states have put further restrictions on their Constitution and REQUIRE LEO's to get a warrant for this type of action. Again this wouldn't apply to Federal Officers operating in the state, but does restrict State officer's while enforcing a State Statue.Originally Posted by Switchback
Who cares where he got it, this isn't a research paper, he was just trying to help. Good information regardless.Nice copy/paste action TPD. You really should source your info if you're going to act like you came up with it. This place comes to mind:
CXT_180, I think in florida an offier needs a warrant, even if he has PC. UNLESS a keyholder is there and they give him permission
Thank you Scotty22 for clearing that up. :D

If trash and/or trash cans are deemed to be abandoned property. Is it safe to assume that contraband found in said trash cannot directly be linked to the owner of the cans? Is it also safe to assume that it would be fairly difficult to prove in court that a roachclip found in this "abandoned" trashcan is in fact the owner's pot? Am I wrong here?
"Back in the thirties we were told we must collectivize the nation because the people were so poor. Now we are told we must collectivize the nation because the people are so rich."
William F. Buckley, Jr.
"When there are grounds for suspicion that a person has committed a crime or misdemeanor, and public justice and the good of the community require that the matter should be examined, there is said to be a probable cause for, making a charge against the accused, however malicious the intention of the accuser may have been." (from the website referred to above, http://www.lectlaw.com/def2/p089.htm)
The author of this sentence refers to suspicion - does he mean reasonable suspicion? Is it just me or this author mixing reasonable suspicion with probable cause? (Reasonable suspicion and probable cause are separate legal principles, right?) Anybody disagree? Thanks in advance for clarifying.
