    Red face When overtaking on the right...

    What I would like to know is...
    In the Florida Statues 316.084
    (a) When the vehicle is making or about to make a left turn.
    A car can overtake and pass another vehical on the right...when cond. permit in safety.

    When the above is true why did I get a ticket when

    1 The car that was turning left changed there mind and turned right and into and accross my path towards a parking lot.
    2 She did not signal
    3 Look before turning.
    F.S. 316.085
    (2) No vehicle shall change course untill determined that veicle is not being approched or passed by any other vehicle in the direction the driver desires to move and done with safety and without interfering with vehicle approaching.

    The Statutes are shortend and not all there.

    She lives on the street where she was making the left turn. I had plenty of room to go around safetly. Her sudden decision to turn right is????

    No one here has any idea. You received a ticket; therefore, the evidence must not have supported your version of events. You should ask the driver or the officer who conducted the investigation

    It would be hard to say she saw me and then continued to make the turn.
    She said she did not see me. I say she did not look before she turned or she would have seen me right there on her side. What else could it be? Blind spot?

    Umm, OK. We are not there and cannot speak to her. Sorry you got a ticket that was unjustified. Perhaps plead not-guilty?

    So what some of you are saying is that even though it was ok to overtake and pass a car making or about to make a left turn. (By the Statute) Something else the PO saw or heard made me totaly at fault?

    I really would like to plead not-guilty but I think the judge would be just as hard if not harder to convince. And thats why I'm here. I'm trying to learn why and how I was at fault. I know it's easy to say (you got the ticket so you must be wrong). I'm willing to give all the details. Just ask.

    I didn't witness it... Sounds to me like you hit eachother... Maybe you thought the other driver was turning left because she slowed down, and you attempted to pass on the right... I don't know... She's at fault for possibly changing direction without proper caution, and you're at fault for unsafe passing.... Don't like it, the courthouse is open on Monday...
