If you were unjustly cited, then get all of your evidence together, and fight it in court. So far as I know, there are no psychic LEOs here, so no one can say whether you were right.

Unsafe passing... There was at least 10 feet between her car and the edge of the roadway with an open parking lot further to the right. There is also a large tree to the right of me just in the parking lot.

That does not mean that under many circumstances you would not have made the pass ok, only that it was poor judgement on your behalf.
You assumed that she would turn......... well, as everyone knows ppl change thier minds.
Changing her mind did not put her in danger, your attempt at passing did.
So, slow down a bit.
Give ppl room to make mistakes.........save on repair bills, and costly tickets.

were you passing on the shoulder or was it 2 lanes in each direction? If it was 1 lane and you were passing on the shoulder I would say you were at fault because it is the other driver's lane of travel until they actually turn. It would be your responsibility to yield to them (ie. make certain they are turning before passing.) If it was 2 lanes of travel in the same direction or the other driver was in a left turn lane and entered the right lane from the left lane or turn lane then she took away your lane of travel and would be at fault.
