    I did call and talked to a PO (not the PO at crash) and he said it did not mater if her intent was to turn left. Because there was a crash it must not have been safe. Wow!

    Look, since it wasn't obvious from the previous posts, I will say this.

    If you were unjustly cited, then get all of your evidence together, and fight it in court. So far as I know, there are no psychic LEOs here, so no one can say whether you were right.

    Just walk in with all of the facts, diagrams, and witnesses you can gather.

    Ok I agree with your view except;
    I know for a fact she was sitting there at a full stop wating to turn left.
    She was in fact still at a stop as I proceeded to go around.

    Unsafe passing... There was at least 10 feet between her car and the edge of the roadway with an open parking lot further to the right. There is also a large tree to the right of me just in the parking lot.

    So there was not a clear lane, road to the right of you.
    Just the edge of the roadway, and from the sounds of it a somewhat dangerous place to pass a car.
    Esp with a large tree on your side up and coming.

    That does not mean that under many circumstances you would not have made the pass ok, only that it was poor judgement on your behalf.

    You assumed that she would turn......... well, as everyone knows ppl change thier minds.
    Changing her mind did not put her in danger, your attempt at passing did.

    So, slow down a bit.
    Give ppl room to make mistakes.........save on repair bills, and costly tickets.

    were you passing on the shoulder or was it 2 lanes in each direction? If it was 1 lane and you were passing on the shoulder I would say you were at fault because it is the other driver's lane of travel until they actually turn. It would be your responsibility to yield to them (ie. make certain they are turning before passing.) If it was 2 lanes of travel in the same direction or the other driver was in a left turn lane and entered the right lane from the left lane or turn lane then she took away your lane of travel and would be at fault.

    I didn't see this when i posted. sounds like you weren't in a travel lane when you passed and would be at fault

    You can try to take it to court and see if the judge agrees with your story.
