    Question Considered Rape???

    I am in high school. One of my classes is Health. In class we were discussing rape and date rape. Out of curiosity I asked my teacher, " Is there a such thing as Oral Sex rape? Is this a possibility?" She said that she was not sure, and that she though it could be do to the fact that the male could be stronger than the female. From a police officer perspective, can you charge some one with Oral Sex Rape? :confused:

    Not a cop, but I think the Prosecutors do the charging anyway. No, I think that you would be charged with an Acevada then.

    In Texas, Sexual Assault includes :
    Text
    (B) causes the penetration of the mouth of another person by
    the sexual organ of the actor, without that person's consent; or

    (C) causes the sexual organ of another person, without that
    person's consent, to contact or penetrate the mouth, anus, or sexual
    organ of another person, including the actor; or

    So to answer your question, yes.

    In NV, it is any penetration into the human body however slight is deemed to be sexual assault. (dealing with sexual areas.....no finger in the ear )

    Forced oral sex...whether giving or receiving can be deemed sexual assault as oral sex can involve penetration.
