Laws re: flasks in public

(In CA) - What are the laws regarding someone who is drinking in public from a flask?

How about just walking with a flask? Does it count as an "open container?"

I quite often take hot tea or soup for that matter out with me on nights and no one has ever questioned me over it

I think the short answer is that it IS an open container, but I don't know many people who carry a flask, so at least around here its a non-issue.

A hip flask? Definitely an open container. Just like a half-empty bottle of whiskey...

Having said that - if you just have it in your pocket then it won't attract the attentions of the police. If you have it out and are drinking from it then there is no longer any dispuite about OC.

hell ya, i went to detroit with my school to the hidelburg street, youll be familiar with that, its the ****ty garbage into art work with vacuums with gloves on the handle and stuff. Well we seen a man at 0830 drinking a 40 in a brown paper bag while his "boys" were smoking black and milds drinking from a paper bag looked like a pint, lmao.
