My "friend" has an arrest warrant and...

he says it's from 10 years ago. He had no confrontation with the law in those 10 years so that's why he's not in custody.

Is this possible or is he pulling my leg? Are the cops still actively pursuing him?

EDIT: He hasn't been in hiding or anything. In fact he's been at the same address for 6 years and the same job for 8 years. So why haven't the cops checked up at those locations?

Unless it is for a felony, they probably won't pursue him. My advice is for him to check it out. The statue of limitations might be up on the warrant. However, if during a routine stop it is found that a warrant is present, he might find himself under arrest.

I know there are a lot of jurisdictions that are so inundated with warrants that they actively look for the average felony warrant for a week or so and then it slips back to the back-burner while newer stuff takes their interests.

This is often jsut the nature of the beast when you have a high volume of warrants constantly coming in. So, your friends story could be true.

It is a possiblility that a warrant is still active for him, however no one will be actively looking for him. Usually, at least here in my state, a felony warrant, excluding Murder of course, is valid for 7 years. A misdemeanor warrant is good for 2 years.

    Greetings:

It depends on the state and local jurisdiction. In california, once an arrest warrant is issued, the statute of limitations on the crime is tolled. There is no statute on warrants. They are good forever. For instance, Roman Polanski is still wanted in Los Angeles County. However, People v. Rost is an interesting case that effects warrants. Essentially, once a warrant has been issued, the police must make a diligent effort to find the fugitive. If they don't, the case can be dismissed because the fugitive was denied a right to a speedy trial. The arrest on the warrant would still be good, and the local prosecutor can re-file the case.

Check with your local police department - more and more, they are putting warrant checks on line - try http://www.sdsheriff.net/waar/waar.aspx/waar.html

I was going to tell you to do what HiTech suggested. My county has a website which has all issued warrants, as well as pics if available, on it. I have found it to be very useful.

Also, giving your local PD a call wouldn't hurt.
